0001| AN ACT | 0002| RELATING TO COUNTIES; PROVIDING THAT CERTAIN COUNTY ORDINANCES TAKE | 0003| EFFECT IMMEDIATELY AFTER PASSAGE; AMENDING A SECTION OF THE NMSA 1978. | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. Section 4-37-9 NMSA 1978 (being Laws 1975, Chapter | 0007| 312, Section 9) is amended to read: | 0008| "4-37-9. COUNTY ORDINANCES--RECORDING AND PUBLICATION--EFFECTIVE | 0009| DATE.-- | 0010| A. All county ordinances, immediately after their passage, | 0011| shall be recorded in a book kept for that purpose and shall be authen- | 0012| | 0013| ticated by the signature of the county clerk. | 0014| B. No ordinance shall take effect until thirty days after | 0015| the ordinance has been recorded in the book kept by the county for | 0016| that purpose. | 0017| C. Notwithstanding the provisions of Subsection B of this | 0018| section, when a board of county commissioners declares that it is | 0019| necessary for the public peace, health and safety that an ordinance | 0020| take effect immediately after passage, the ordinance shall take effect | 0021| when it is recorded in the book kept by the county for that purpose | 0022| and authenticated by the signature of the county clerk." | 0023| Section 2. EFFECTIVE DATE.--The effective date of the | 0024| provisions of this act is July 1, 1997. | 0025| |
