0001| AN ACT | 0002| RELATING TO COUNTY FUNDS; PERMITTING CERTAIN FUNDS TO BE USED FOR | 0003| BURIAL OF INDIGENTS. | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. Section 24-13-3 NMSA 1978 (being Laws 1939, Chapter | 0007| 224, Section 3, as amended) is amended to read: | 0008| "24-13-3. EXPENSES FOR BURIAL.--The expenses for the burial or | 0009| cremation of an indigent person may be paid by the county out of the | 0010| general fund or from the county indigent hospital claims fund in an | 0011| amount up to one thousand two hundred dollars ($1,200) for the burial | 0012| of any adult or minor." | 0013| Section 2. Section 27-5-7.1 NMSA 1978 (being Laws 1993, Chapter | 0014| 321, Section 16) is amended to read: | 0015| "27-5-7.1. COUNTY INDIGENT HOSPITAL CLAIMS FUND--AUTHORIZED USES | 0016| OF THE FUND.-- | 0017| A. The fund shall be used: | 0018| (1) to meet the county's contribution for support of | 0019| sole community provider payments as calculated by the department for | 0020| that county; and | 0021| (2) to pay all claims that have been approved by the | 0022| board that are not matched with federal funds under the state medicaid | 0023| program. | 0024| B. The fund may be used to meet the county's obligation | 0025| under Section 27-10-4 NMSA 1978. | 0001| C. The fund may be used to pay the burial costs of indigent | 0002| persons. | 0003| D. Until June 30, 1996, the cash reserves from the | 0004| fund may be used to meet the county's obligation under Section 27- | 0005| 10-4 NMSA 1978." |
