0001| AN ACT | 0002| RELATING TO POST-SECONDARY EDUCATIONAL INSTITUTIONS; AUTHORIZING A | 0003| POST-SECONDARY EDUCATIONAL INSTITUTION GOVERNING BOARD TO ESTABLISH A | 0004| CAMPUS POLICE FORCE; PROVIDING FOR THE AUTHORITY OF THE CAMPUS POLICE | 0005| THUS ESTABLISHED. | 0006| | 0007| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0008| Section 1. A new section of Chapter 29, Article 5 NMSA 1978 is | 0009| enacted to read: | 0010| "POST-SECONDARY EDUCATIONAL INSTITUTIONS--BOARDS AUTHORIZED TO | 0011| ESTABLISH CAMPUS POLICE FORCE--QUALIFICATIONS AND AUTHORITY OF CAMPUS | 0012| POLICE OFFICERS.-- | 0013| A. As used in this section "post-secondary educational | 0014| institution" means a community college operating pursuant to Chapter | 0015| 21, Article 13 NMSA 1978, a technical and vocational institute | 0016| operating pursuant to Chapter 21, Article 16 NMSA 1978 and an area | 0017| vocational school operating pursuant to Chapter 21, Article 17 NMSA | 0018| 1978. | 0019| B. The governing board of a post-secondary educational | 0020| institution may adopt and promulgate traffic regulations to apply to | 0021| areas within the exterior boundaries of the lands under control of the | 0022| board, including streets and highways. | 0023| C. The governing board of a post-secondary educational | 0024| institution may employ and assign duties to persons as campus police | 0025| officers for the community college. | 0001| D. Persons employed as campus police officers by a post- | 0002| secondary educational institution governing board: | 0003| (1) shall have the powers of peace officers within | 0004| the exterior boundaries of lands under the control of the board, | 0005| including streets and highways; | 0006| (2) shall at all times while on duty carry | 0007| commissions of office issued by the board; | 0008| (3) shall fulfill the requirements for certification | 0009| in Subsection A of Section 29-7-6 NMSA 1978 within one year of the | 0010| date of first employment; | 0011| (4) may enforce all applicable laws, ordinances and | 0012| campus traffic regulations within the territory in which they have | 0013| powers of peace officers; and | 0014| (5) may make arrests for violations of laws, | 0015| ordinances and campus traffic regulations that they have authority to | 0016| enforce, but no arrest is valid unless the arresting campus police | 0017| officer is at the time of the arrest wearing: | 0018| (a) a distinctive badge issued to him by the | 0019| post-secondary educational institution governing board and bearing the | 0020| name of the post-secondary educational institution; and | 0021| (b) a distinctive uniform prescribed and | 0022| issued to him by the board." |
