0001| AN ACT | 0002| RELATING TO PUBLIC SCHOOLS; CREATING A STUDENT ATTENDANCE OVERSIGHT | 0003| TASK FORCE. | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. STUDENT ATTENDANCE OVERSIGHT TASK FORCE--CREATION-- | 0007| TERMINATION.--The "student attendance oversight task force" is | 0008| created. The task force shall function from the date of its | 0009| appointment until the first day of December prior to the second | 0010| session of the forty-third legislature. | 0011| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.-- | 0012| A. The student attendance oversight task force shall be | 0013| composed of six legislative members; six public advisory members, two | 0014| of whom shall be graduates of or current students at an alternative | 0015| high school in the state; and one representative from the state | 0016| department of public education. | 0017| B. Three members of the house of representatives shall be | 0018| appointed by the speaker of the house of representatives and three | 0019| members of the senate shall be appointed by the committees' committee | 0020| of the senate or, if the senate appointments are made in the interim, | 0021| by the president pro tempore of the senate after consultation with and | 0022| the agreement of a majority of the members of the committees' | 0023| committee. Members shall be appointed from each house so as to give | 0024| the two major political parties in each house the same proportional | 0025| representation on the task force as prevails in each house; however, | 0001| in no event shall either party have less than one member from each | 0002| house on the task force. Vacancies on the task force shall be filled | 0003| by appointment in the same manner as the original appointments. | 0004| C. So as to represent the state's ethnic and geographic | 0005| diversity, six public advisory members shall be appointed by the | 0006| governor. The public members of the task force shall be paid per diem | 0007| and mileage in accordance with the provisions of the Per Diem and | 0008| Mileage Act plus reimbursement for reasonable actual expenses. | 0009| D. The task force shall also include one advisory member | 0010| representing the state department of public education appointed by the | 0011| president of the state board of education. | 0012| E. The speaker of the house of representatives and the | 0013| president pro tempore of the senate shall each designate one co- | 0014| chairman of the task force. | 0015| Section 3. DUTIES.-- | 0016| A. After its appointment, the student attendance oversight | 0017| task force shall hold one organizational meeting to develop a work | 0018| plan and budget for the ensuing interim. The work plan and budget | 0019| shall be submitted to the New Mexico legislative council for approval. | 0020| B. Upon approval of the work plan and budget by the | 0021| legislative council, the task force shall oversee the implementation | 0022| of the legislative directives relating to the student attendance and | 0023| graduation, including development of a method to allocate the funds | 0024| which each school district receives under the state equalization | 0025| guarantee to create incentives to improve the student attendance and | 0001| graduation rate. | 0002| C. The task force shall recommend legislation or changes if | 0003| any are found to be necessary to the legislature. | 0004| Section 4. REPORT.--The student attendance oversight task force | 0005| shall make a report of its findings and recommendations for the | 0006| consideration of the second session of the forty-third legislature. | 0007| The reports and suggested legislation shall be made available to the | 0008| New Mexico legislative council on or before November 1 preceding the | 0009| session. | 0010| Section 5. STAFF.--The staff for the student attendance | 0011| oversight task force shall be provided by the legislative council | 0012| service. |
