0001| AN ACT | 0002| RELATING TO MOTOR VEHICLES; AMENDING THE MOTOR VEHICLE CODE PERTAINING | 0003| TO SPEED REGULATION. | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. Section 66-7-301 NMSA 1978 (being Laws 1978, Chapter | 0007| 35, Section 405, as amended) is amended to read: | 0008| "66-7-301. SPEED REGULATION.-- | 0009| A. No person shall drive a vehicle on a highway at a speed | 0010| greater than: | 0011| (1) fifteen miles per hour on all highways when | 0012| passing a school while children are going to or leaving school and | 0013| when the school zone is properly posted; | 0014| (2) thirty miles per hour in any business or | 0015| residence district; | 0016| (3) seventy-five miles per hour, provided that the | 0017| maximum speed on interstate highways for commercial motor vehicles and | 0018| any motor vehicle towing a manufactured home or another motor vehicle | 0019| shall be sixty-five miles an hour; and | 0020| (4) the posted speed limit in construction zones, | 0021| provided that the posted speed limit shall be determined by an | 0022| engineering study performed by the state highway and transportation | 0023| department. | 0024| B. In every event, speed shall be so controlled by the | 0025| driver as may be necessary: | 0001| (1) to avoid colliding with any person, vehicle or | 0002| other conveyance on or entering the highway; | 0003| (2) to comply with legal requirements as may be | 0004| established by the state highway and transportation department or the | 0005| New Mexico state police division of the department of public safety | 0006| and the duty of all persons to use due care; and | 0007| (3) to protect workers in a construction zone. | 0008| C. The speed limits set forth in Subsection A of this | 0009| section may be altered as authorized in Section 66-7-303 NMSA | 0010| 1978." |
