0001| AN ACT | 0002| RELATING TO COMMISSIONS; CREATING A CESAR ESTRADA CHAVEZ COMMISSION TO | 0003| DEVELOP, PROMOTE, COORDINATE AND REVIEW PLANS AND ACTIVITIES FOR THE | 0004| CESAR ESTRADA CHAVEZ LEGAL HOLIDAY; CREATING A FUND; DECLARING AN | 0005| EMERGENCY. | 0006| | 0007| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0008| Section 1. Section 12-5-2 NMSA 1978 (being Laws 1969, Chapter | 0009| 114, Section 1, as amended by Laws 1987, Chapter 3, Section 1 and also | 0010| by Laws 1987, Chapter 309, Section 1) is amended to read: | 0011| "12-5-2. LEGAL HOLIDAYS--DESIGNATION.--Legal public holidays in | 0012| New Mexico are: | 0013| A. New Year's day, January 1; | 0014| B. Martin Luther King, Jr.'s birthday, third Monday in | 0015| January; | 0016| C. Washington's and Lincoln's birthday, President's day, | 0017| third Monday in February; | 0018| D. Cesar E. Chavez Day, last Saturday in March; | 0019| E. Memorial day, last Monday in May; | 0020| F. Independence day, July 4; | 0021| G. Labor day, first Monday in September; | 0022| H. Columbus day, second Monday in October; | 0023| I. Armistice day and Veterans' day, November 11; | 0024| J. Thanksgiving day, fourth Thursday in November; and | 0025| K. Christmas day, December 25." | 0001| Section 2. CESAR ESTRADA CHAVEZ COMMISSION--CREATED--DEFINED-- | 0002| MEMBERS--TERMS--COMPENSATION.-- | 0003| A. The "Cesar Estrada Chavez commission" is created. The | 0004| purpose of the commission is to develop, promote, coordinate and | 0005| review statewide plans and activities for the annual commemoration and | 0006| celebration of the birthday of Cesar Estrada Chavez in accordance with | 0007| Section 12-5-2 NMSA 1978. | 0008| B. As used in Sections 2 through 5 of this act, | 0009| "commission" means the Cesar Estrada Chavez commission. | 0010| C. The commission shall be comprised of thirteen members as | 0011| follows: | 0012| (1) four members appointed by the governor; | 0013| (2) one member appointed by the president pro tempore | 0014| of the senate; | 0015| (3) one member appointed by the minority leader of | 0016| the senate; | 0017| (4) one member appointed by the speaker of the house | 0018| of representatives; | 0019| (5) one member appointed by the minority leader of | 0020| the house of representatives; | 0021| (6) the state treasurer or his designee; | 0022| (7) the secretary of state or his designee; | 0023| (8) a Native American appointed by the New Mexico | 0024| office of Indian affairs; | 0025| (9) the director of the human rights division of the | 0001| labor department or his designee; and | 0002| (10) the chairman of the state corporation commission | 0003| or his designee. | 0004| D. Members of the commission shall be appointed initially | 0005| for terms as follows: seven members shall be appointed for terms of | 0006| two years and six members shall be appointed for terms of four years. | 0007| The initial terms shall be determined by random drawing. After the | 0008| expiration of the initial terms, all members shall be appointed for | 0009| four-year terms. The initial commission shall be appointed within | 0010| forty-five days from the effective date of this act. Vacancies | 0011| resulting from the death or resignation of a member shall be filled by | 0012| appointment by the commission chairman for the unexpired portion of | 0013| the term of the member creating the vacancy. In filling any vacancy, | 0014| the commission chairman may accept recommendations from the person who | 0015| originally appointed the member creating the vacancy. | 0016| E. The members of the commission shall receive no | 0017| compensation for their service. | 0018| F. The members of the commission shall select a chairman | 0019| from the members of the commission. | 0020| G. The commission shall appoint an executive director to | 0021| coordinate all activities on the commission's behalf. | 0022| Section 3. CESAR ESTRADA CHAVEZ FUND--CREATED.-- | 0023| A. There is created within the state treasury for the | 0024| commission a fund that shall be designated as the "Cesar Estrada | 0025| Chavez fund" that shall consist of appropriations, endowments and | 0001| bequests. | 0002| B. Money from the fund shall be disbursed upon warrant of | 0003| the secretary of finance and administration pursuant to vouchers | 0004| submitted by the executive director of the commission for the purpose | 0005| of carrying out the provisions of this act. | 0006| Section 4. DUTIES OF THE COMMISSION.--The duties of the | 0007| commission shall include the following: | 0008| A. to develop a plan for the commemoration and celebration | 0009| of the official legal holiday honoring Cesar Estrada Chavez; | 0010| B. to develop and submit to the governor and the | 0011| legislature recommendations for specific commemorative activities to | 0012| be undertaken by the state for the Cesar Estrada Chavez holiday; | 0013| C. to coordinate state plans and activities with federal | 0014| plans and activities for the commemoration and celebration of the | 0015| Cesar Estrada Chavez holiday; | 0016| D. to develop, with other agencies of the state, an | 0017| interpretive program that explores the historical, social, political | 0018| and cultural themes associated with the life and works of Cesar | 0019| Estrada Chavez; | 0020| E. to develop and acquire interpretive materials and | 0021| publications on the significance of Cesar Estrada Chavez' work and | 0022| develop a commemorative program for state employees, school children | 0023| and the general public; | 0024| F. to create a process to facilitate the implementation of | 0025| the master plan project and other recommendations made by the | 0001| commission; | 0002| G. to prepare and provide to the general public advice, | 0003| assistance and information on the Cesar Estrada Chavez holiday | 0004| activities recommended by the commission; | 0005| H. to submit other studies, reports and recommendations to | 0006| the governor and the legislature as are necessary with respect to | 0007| activities for the continued commemoration and celebration of Cesar | 0008| Estrada Chavez; and | 0009| I. to accept endowments and bequests for the Cesar Estrada | 0010| Chavez fund. | 0011| Section 5. COMMISSION REPORT.--The commission shall make an | 0012| initial report to the governor and the legislature of its findings, | 0013| conclusions, proposals and recommendations for the observance of the | 0014| Cesar Estrada Chavez holiday within ninety days of the effective date | 0015| of this act. The commission shall submit an annual report of its | 0016| activities to the legislature no later than December 1 of each year. | 0017| The first annual report shall be submitted no later than December 1, | 0018| 1997. | 0019| Section 6. EMERGENCY.--It is necessary for the public | 0020| peace, health and safety that this act take effect immediately. | 0021| |
