0002| RELATING TO STATUTORY CONSTRUCTION; INCLUDING PLANNING AND DESIGNING

0003| WITHIN THE MEANINGS OF PAVE OR CONSTRUCT; DECLARING AN EMERGENCY.

0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0006|      Section 1.  A new section of Chapter 12, Article 2 NMSA 1978 is
    |
0007| enacted to read:
    |
0008|      "USE OF CONSTRUCT OR PAVE IN STATUTE.--As used in all New Mexico
    |
0009| statutes unless explicitly stated otherwise:
    |
0010|           A.  "construct" may include the planning or designing phase
    |
0011| of a construction project if those functions have not been completed;
    |
0012| and
    |
0013|           B.  "pave" may include the planning, designing or
    |
0014| engineering phase of a paving project if those functions have not been
    |
0015| completed."
    |
0016|      Section 2.  EMERGENCY.--It is necessary for the public
    |
0017| peace, health and safety that this act take effect immediately.
