0001| AN ACT | 0002| RELATING TO RADIO COMMUNICATIONS; PROVIDING FOR LEASE OF | 0003| EXCESS CAPACITY ON THE STATE-OWNED RADIO SYSTEM; ESTABLISHING | 0004| REQUIREMENTS AND LIMITATIONS; DECLARING AN EMERGENCY. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. A new Section 15-2-2.1 NMSA 1978 is enacted | 0008| to read: | 0009| "15-2-2.1. LEASE OF RADIO COMMUNICATIONS NETWORK-- | 0010| CONDITIONS AND REQUIREMENTS.--In exercising supervisory | 0011| control pursuant to Section 15-2-2 NMSA 1978, the radio | 0012| communications bureau of the communications division of the | 0013| general services department may lease to a private entity | 0014| excess capacity on its radio communications property, | 0015| including buildings, towers or antennas, provided that: | 0016| A. the lease conforms with competitive | 0017| procurement requirements of the Procurement Code; | 0018| B. the lease is for an equal value exchange of | 0019| money or property; | 0020| C. the secretary of general services certifies | 0021| that the excess capacity will be available for at least the | 0022| duration of the lease; | 0023| D. if the lease exceeds ten years, the lease is | 0024| first approved by the state board of finance; | 0025| E. the radio communications bureau has submitted | 0001| to the legislative finance committee a detailed plan for the | 0002| use of excess capacity being leased and an assessment of how | 0003| the lease will affect public sector uses; and | 0004| F. income from the leases shall be deposited to | 0005| the credit of the radio communications bureau and used to | 0006| carry out the duties of the bureau." | 0007| Section 2. EMERGENCY.--It is necessary for the public | 0008| peace, health and safety that this act take effect | 0009| immediately. | 0010| |
