0001| AN ACT | 0002| RELATING TO PUBLIC SCHOOLS; AMENDING SECTION 61-14B-8 NMSA 1978 (BEING | 0003| LAWS 1996, CHAPTER 57, SECTION 8). | 0004| | 0005| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0006| Section 1. Section 61-14B-8 NMSA 1978 (being Laws 1996, Chapter | 0007| 57, Section 8) is amended to read: | 0008| "61-14B-8. EXEMPTIONS.-- | 0009| A. Nothing in the Speech Language Pathology, Audiology and | 0010| Hearing Aid Dispensing Practices Act shall be construed to prevent | 0011| qualified members of other recognized professions that are licensed, | 0012| certified or registered under New Mexico law or regulation from | 0013| rendering services within the scope of their license, certificate or | 0014| registration, provided they do not represent themselves as holding a | 0015| license in speech language pathology, audiology or hearing aid | 0016| dispensing. | 0017| B. Nothing in the Speech Language Pathology, Audiology and | 0018| Hearing Aid Dispensing Practices Act restricts or prevents activities | 0019| of a speech-language pathology or audiology nature or the use of the | 0020| official title of the position for which they were employed; provided | 0021| such persons are performing those activities as part of the duties for | 0022| which they were employed and performing those activities solely within | 0023| the confines of or under the jurisdiction of the state board of | 0024| education in which they are employed and do not offer to render | 0025| speech-language pathology or audiology services to the public for a | 0001| fee, monetary or otherwise, paid to the person, institution or agency. | 0002| C. Nothing in the Speech Language Pathology, Audiology and | 0003| Hearing Aid Dispensing Practices Act prevents qualified members of | 0004| other recognized professional groups, such as licensed physicians, | 0005| dentists or teachers of the deaf, from doing appropriate work in the | 0006| area of communication disorders consistent with the standards and | 0007| ethics of their respective professions. | 0008| D. Nothing in the Speech Language Pathology, Audiology | 0009| and Hearing Aid Dispensing Practices Act restricts the activities | 0010| and services of a speech language pathology or audiology graduate | 0011| student at an accredited or approved college or university or an | 0012| approved clinical training facility; provided that these | 0013| activities and services constitute part of his supervised course | 0014| of study and that he is designated as a speech language pathology | 0015| or audiology graduate student or other title clearly indicating | 0016| the training status appropriate to his level of training." |
