0011| RELATING TO TELECOMMUNICATIONS; AMENDING SECTION 63-9F-3 NMSA
|
0012| 1978 (BEING LAWS 1993, CHAPTER 54, SECTION 3, AS AMENDED) TO
|
0013| CLARIFY INTRASTATE TELEPHONE SERVICES FOR PURPOSES OF THE
|
0014| TELECOMMUNICATIONS ACCESS ACT.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 63-9F-3 NMSA 1978 (being Laws 1993,
|
0018| Chapter 54, Section 3, as amended) is amended to read:
|
0019| "63-9F-3. DEFINITIONS.--As used in the Telecommunications
|
0020| Access Act:
|
0021| A. "commission" means the commission for deaf and
|
0022| hard-of-hearing persons;
|
0023| B. "communications assistant" means an individual
|
0024| who translates conversation from text to voice and from voice
|
0025| to text between two end users of a telecommunications service;
|
0001| C. "department" means the general services
|
0002| department;
|
0003| D. "impaired" means having an impairment of or
|
0004| deficit in the ability to hear or speak, or both;
|
0005| E. "intrastate telephone services" means all
|
0006| charges for access lines, special services [including all
|
calls originating and terminating in the state] and intrastate
|
0008| toll services, including all calls originating and terminating
|
0009| in the state;
|
0010| F. "specialized telecommunications equipment" means
|
0011| devices that when connected to a telephone enable or assist an
|
0012| impaired individual to communicate with another individual
|
0013| using the telephone network;
|
0014| G. "telecommunications company" means an
|
0015| individual, corporation, partnership, joint venture, company,
|
0016| firm, association, proprietorship or other entity that provides
|
0017| public telecommunications services, and includes cellular
|
0018| service companies as defined in Subsection B of Section 63-9B-3
|
0019| NMSA 1978; and
|
0020| H. "telecommunications relay system" means a
|
0021| statewide telecommunications system through which an impaired
|
0022| individual using specialized telecommunications equipment is
|
0023| able to send or receive messages to and from an individual who
|
0024| is not impaired and whose telephone is not equipped with
|
0025| specialized telecommunications equipment and through which the
|
0001| unimpaired individual is able, by using voice communications,
|
0002| to send and receive messages to and from an impaired person."
|
0003| Section 2. EFFECTIVE DATE.--The effective date of the
|
0004| provisions of this act is July 1, 1997.
