0011| RELATING TO PUBLIC SCHOOLS; AMENDING CONDITIONS FOR SABBATICAL
|
0012| LEAVE FOR CERTIFIED EMPLOYEES.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 22-10-25 NMSA 1978 (being Laws 1969,
|
0016| Chapter 116, Section 4, as amended) is amended to read:
|
0017| "22-10-25. MINIMUM CONDITIONS FOR SABBATICAL LEAVE.--Any
|
0018| sabbatical leave program adopted by a [local] school district
|
0019| or a state agency shall provide the following as minimum
|
0020| conditions:
|
0021| A. only those certified employees who have
|
0022| completed at least six years of continuous service in a
|
0023| certified capacity with [the] any school district or those
|
0024| certified school instructors who have completed at least six
|
0025| years of continuous service in a certified capacity with the
|
0001| state agency are eligible. For purposes of this section, a
|
0002| leave of absence without pay shall not be considered as an
|
0003| interruption of continuous service, but the leave of absence
|
0004| without pay shall not be counted in determining the six-year
|
0005| requirement;
|
0006| B. further sabbatical leave may be granted in the
|
0007| seventh year of service following a period of sabbatical leave
|
0008| under the same conditions as other sabbatical leaves are
|
0009| granted;
|
0010| C. sabbatical leave shall be granted only upon
|
0011| agreement by the employee to return to the school system or
|
0012| state agency for at least two years following the leave or
|
0013| [repayment] to repay to the school district or state agency
|
0014| [of] the salary received during the period of leave. Such
|
0015| agreement shall be placed in a supplementary contract executed
|
0016| prior to authorization for the sabbatical leave;
|
0017| D. the maximum term of any one period of sabbatical
|
0018| leave shall be one year;
|
0019| E. the employee shall be guaranteed an equivalent
|
0020| or better position upon return to the school system or state
|
0021| agency;
|
0022| F. if regular salary increments for length of
|
0023| service are contained in the salary schedule, the period of
|
0024| leave shall be counted as period of service in the computation
|
0025| of future length of service increments; and
|
0001| G. the employee may continue his participation in
|
0002| the educational retirement plan by making appropriate
|
0003| contributions as agreed by the local school board or the
|
0004| governing authority of the state agency and the educational
|
0005| retirement board."
