0011|     RELATING TO LAW ENFORCEMENT; PROVIDING THAT CERTAIN LAW
    |
0012|     ENFORCEMENT RECORDS MAY BE WITHHELD FROM PUBLIC INSPECTION;
    |
0013|     AMENDING SECTIONS OF THE NMSA 1978.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 14-2-1 NMSA 1978 (being Laws 1947,
    |
0017|     Chapter 130, Section 1, as amended) is amended to read:
    |
0018|          "14-2-1.  RIGHT TO INSPECT PUBLIC RECORDS--EXCEPTIONS.--
    |
0019|     Every person has a right to inspect any public records of this
    |
0020|     state except:
    |
0021|               A.  records pertaining to physical or mental
    |
0022|     examinations and medical treatment of persons confined to any
    |
0023|     institution;
    |
0024|               B.  letters of reference concerning employment,
    |
0025|     licensing or permits;
    |
0001|               C.  letters or memorandums [which] that are
    |
0002|     matters of opinion in personnel files or students' cumulative
    |
0003|     files;
    |
0004|               D.  law enforcement records that reveal confidential
    |
0005|     sources, methods or information [or individuals accused but
    |
    not charged with a crime] that if disclosed would seriously
    |
0007|     interfere with the effectiveness of an investigation.  Law
    |
0008|     enforcement records include evidence in any form received or
    |
0009|     compiled in connection with any criminal investigation or
    |
0010|     prosecution by any law enforcement or prosecuting agency,
    |
0011|     including inactive matters or closed investigations to the
    |
0012|     extent that they contain the information listed above;
    |
0013|               E.  as provided by the Confidential Materials Act;
    |
0014|     and
    |
0015|               F.  as otherwise provided by law."
    |
0016|          Section 2.  Section 29-10-4 NMSA 1978 (being Laws 1975,
    |
0017|     Chapter 260, Section 4, as amended) is amended to read:
    |
0018|          "29-10-4.  CONFIDENTIALITY OF ARREST RECORDS.--Arrest
    |
0019|     record information that reveals confidential sources, methods
    |
0020|     or information [or individuals accused but not charged with
    |
    a crime and that is maintained by the state or any of its
    |
    political subdivisions pertaining to any person charged with
    |
    the commission of any crime is confidential and dissemination
    |
    or revealing the contents of the record, except as provided in
    |
    the Arrest Record Information Act or any other law, is
    |
    unlawful] is confidential and may be withheld from inspection
    |
0002|     if disclosure would seriously interfere with the effectiveness
    |
0003|     of an investigation."
    |
0004|          Section 3.  EFFECTIVE DATE.--The effective date of the
    |
0005|     provisions of this act is July 1, 1997.
