GUBBELS | 0005| | 0006| | 0007| | 0008| FOR THE LEGISLATIVE EDUCATION STUDY COMMITTEE | 0009| | 0010| AN ACT | 0011| RELATING TO PUBLIC SCHOOLS; INCREASING TO FOUR YEARS THE AMOUNT | 0012| OF TIME A PROPERTY TAX MAY BE IMPOSED FOR CAPITAL IMPROVEMENTS | 0013| IN A SCHOOL DISTRICT; AMENDING SECTIONS OF THE PUBLIC SCHOOL | 0014| CAPITAL IMPROVEMENTS ACT. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. Section 22-25-3 NMSA 1978 (being Laws 1975 | 0018| (S.S.), Chapter 5, Section 3, as amended) is amended to read: | 0019| "22-25-3. AUTHORIZATION FOR LOCAL SCHOOL BOARD TO SUBMIT | 0020| QUESTION OF CAPITAL IMPROVEMENTS TAX IMPOSITION.--Any local | 0021| school board may adopt a resolution to submit to the qualified | 0022| electors of the school district the question of whether a | 0023| property tax should be imposed upon the net taxable value of | 0024| property allocated to the school district under the Property | 0025| Tax Code at a rate not to exceed that specified in the | 0001| resolution for the purpose of capital improvements in the | 0002| school district. The resolution shall: | 0003| A. identify the capital improvements for which the | 0004| revenue proposed to be produced will be used; | 0005| B. specify the rate of the proposed tax, which | 0006| shall not exceed two dollars ($2.00) on each one thousand | 0007| dollars ($1,000) of net taxable value of property allocated to | 0008| the school district under the Property Tax Code; | 0009| C. specify the date an election will be held to | 0010| submit the question of imposition of the tax to the qualified | 0011| electors of the district; and | 0012| D. limit the imposition of the proposed tax to no | 0013| more than [three] four property tax years." | 0014| Section 2. Section 22-25-5 NMSA 1978 (being Laws 1975 | 0015| (S.S.), Chapter 5, Section 5, as amended) is amended to read: | 0016| "22-25-5. CONDUCT OF ELECTION--NOTICE--BALLOT.-- | 0017| A. An election on the question of imposing a tax | 0018| under the Public School Capital Improvements Act may be held in | 0019| conjunction with a regular school district election or may be | 0020| conducted as or held in conjunction with a special school | 0021| district election, but the election shall be held prior to July | 0022| 1 of the property tax year in which the tax is proposed to be | 0023| imposed. Conduct of the election shall be as prescribed in the | 0024| School Election Law for regular and special school district | 0025| elections. | 0001| B. The resolution required to be published as | 0002| notice of the election under Section 1-22-4 or 1-22-5 NMSA 1978 | 0003| shall include as the question to be submitted to the voters | 0004| whether a property tax at a rate not to exceed the rate | 0005| specified in the authorizing resolution should be imposed for | 0006| the specified number of property tax years not exceeding | 0007| [three] four years upon the net taxable value of all | 0008| property allocated to the school district for the capital | 0009| improvements specified in the authorizing resolution. | 0010| C. The ballot shall include the information | 0011| specified in Subsection B of this section and shall present the | 0012| voter the choice of voting "for the public school capital | 0013| improvements tax" or "against the public school capital | 0014| improvements tax"." | 0015| Section 3. Section 22-25-8 NMSA 1978 (being Laws 1975 | 0016| (S.S.), Chapter 5, Section 8, as amended) is amended to read: | 0017| "22-25-8. TAX TO BE IMPOSED FOR A MAXIMUM OF [THREE] | 0018| FOUR YEARS.--A tax imposed in a school district as a result | 0019| of an election under the Public School Capital Improvements Act | 0020| shall be imposed for one, two, [or] three or four years | 0021| commencing with the property tax year in which the election was | 0022| held. The local school board may discontinue, by resolution, | 0023| the Public School Capital Improvements Act tax levy at the end | 0024| of the first or second year of the levy.
