ADULT MALE INMATES TRANSFERRED TO OUT-OF-STATE | 0019| CORRECTIONAL FACILITIES--LIMITED PERIOD OF TIME.--Adult male | 0020| inmates transferred to out-of-state correctional facilities for | 0021| the purpose of relieving overcrowding in New Mexico | 0022| correctional facilities may be kept in out-of-state | 0023| correctional facilities for a period of up to twelve months. | 0024| Section 2. TEMPORARY PROVISION--EARLY RELEASE.--In fiscal | 0025| years 1997 and 1998 if inmates of a custody class are in out- | 0001| of-state facilities, the corrections department shall consider | 0002| for emergency release either in-state or out-of-state | 0003| incarcerated nonviolent offender inmates in that custody class | 0004| who are within thirty days of projected release. | 0005| Section 3. APPROPRIATION.--One million one hundred | 0006| thousand dollars ($1,100,000) is appropriated from the general | 0007| fund to the corrections department for expenditure in fiscal | 0008| year 1997 for the purpose of paying for adult male inmates | 0009| transferred to out-of-state correctional facilities to relieve | 0010| overcrowding in state correctional facilities and paying for | 0011| accompanying costs, including medical costs and transportation | 0012| costs. Any unexpended or unencumbered balance remaining at the | 0013| end of fiscal year 1997 shall revert to the general fund. | 0014| Section 4. APPROPRIATION.--One million eight hundred | 0015| thousand dollars ($1,800,000) is appropriated from the general | 0016| fund to the corrections department for expenditure in fiscal | 0017| year 1998 for the purpose of paying for adult male inmates | 0018| transferred to out-of-state correctional facilities and paying | 0019| for accompanying costs, including medical costs and | 0020| transportation costs. Any unexpended or unencumbered balance | 0021| remaining at the end of fiscal year 1998 shall revert to the | 0022| general fund. | 0023| Section 5. EMERGENCY.--It is necessary for the public | 0024| peace, health and safety that this act take effect immediately. | 0025|  |
