0011|     RELATING TO JUDGES; PROVIDING FOR AN ADDITIONAL MAGISTRATE

0012|     JUDGE IN THE SIERRA MAGISTRATE DISTRICT; PROVIDING FOR

0013|     APPOINTMENT AND ELECTION; AMENDING A SECTION OF THE NMSA 1978;

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 35-1-30 NMSA 1978 (being Laws 1968,
    |
0018|     Chapter 62, Section 32) is amended to read:
    |
0019|          "35-1-30.  MAGISTRATE COURT--SIERRA DISTRICT.--There shall
    |
0020|     be <s>[one magistrate]</s> <u>two magistrates</u> in Sierra magistrate
    |
0021|     district with <s>[a]</s> <u>divisions one and two operating as a
</u>    |
<u></u>0022| <u>    single</u> court in Truth or Consequences."
    |
0023|          Section 2.  TEMPORARY PROVISION--APPOINTMENT AND ELECTION-
    |
0024|     -DIVISION TWO.--
    |
0025|               A.  The office of magistrate in the Sierra
    |
0001|     magistrate district division two shall be filled by appointment
    |
0002|     by the governor.  The appointed magistrate shall begin serving
    |
0003|     January 1, 1998 and shall serve until succeeded by a magistrate
    |
0004|     elected pursuant to Subsection B of this section.
    |
0005|               B.  The first full term of the office of magistrate
    |
0006|     in the Sierra magistrate district division two shall be filled
    |
0007|     by election at the general election in 1998, and that term of
    |
0008|     office shall begin on January 1, 1999.
    |
0009|          Section 3.  APPROPRIATION.--Seventy thousand dollars
    |
0010|     ($70,000) is appropriated from the general fund to the
    |
0011|     administrative office of the courts for expenditure in fiscal
    |
0012|     year 1998 for salary, benefits, office space and supplies for
    |
0013|     one new magistrate judge in the Sierra magistrate district
    |
0014|     division two.  Any unexpended or unencumbered balance remaining
    |
0015|     at the end of fiscal year 1998 shall revert to the general
    |
0016|     fund.
