0011|     RELATING TO CRIMINAL LAW; INCREASING THE PENALTIES FOR
    |
0012|     AGGRAVATED BATTERY UPON A PEACE OFFICER; AMENDING A SECTION OF
    |
0013|     THE NMSA 1978.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 30-22-25 NMSA 1978 (being Laws 1971,
    |
0017|     Chapter 265, Section 5) is amended to read:
    |
0018|          "30-22-25.  AGGRAVATED BATTERY UPON PEACE OFFICER.--
    |
0019|               A.  Aggravated battery upon a peace officer consists
    |
0020|     of the unlawful touching or application of force to the person
    |
0021|     of a peace officer with intent to injure that peace officer
    |
0022|     while he is in the lawful discharge of his duties.
    |
0023|               B.  Whoever commits aggravated battery upon a peace
    |
0024|     officer, inflicting an injury to the peace officer [which]
    |
0025|     that is not likely to cause death or great bodily harm, but
    |
0001|     does cause painful temporary disfigurement or temporary loss or
    |
0002|     impairment of the functions of any member or organ of the body,
    |
0003|     is guilty of a [fourth] third degree felony.
    |
0004|               C.  Whoever commits aggravated battery upon a peace
    |
0005|     officer inflicting great bodily harm, or does so with a deadly
    |
0006|     weapon or in any manner whereby great bodily harm or death can
    |
0007|     be inflicted, is guilty of a [third] second degree felony."
    |
0008|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0009|     provisions of this act is July 1, 1997.
