0013|     ANALYSIS AND THE COLLECTION, RETENTION, DISCLOSURE AND USE OF

0014|     GENETIC INFORMATION; PROHIBITING DISCRIMINATION BY INSURERS
    |
0015|     BASED ON GENETIC INFORMATION; PROVIDING PENALTIES.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  SHORT TITLE.--This act may be cited as the
    |
0019|     "Genetic Information Privacy Act".
    |
0020|          Section 2.  DEFINITIONS.--As used in the Genetic
    |
0021|     Information Privacy Act:
    |
0022|               A.  "DNA" means deoxyribonucleic acid, including
    |
0023|     mitochondrial DNA, complementary DNA and any DNA derived from
    |
0024|     ribonucleic acid (RNA);
    |
0025|               B.  "genetic analysis" means a test of the
    |
0001|     individual's DNA, gene products or chromosomes that indicates a
    |
0002|     propensity for or susceptibility to illness, disease,
    |
0003|     impairment or other disorders, whether physical or mental, or
    |
0004|     that demonstrates genetic or chromosomal damage due to
    |
0005|     environmental factors, or carrier status for disease or
    |
0006|     disorder;
    |
0007|               C.  "genetic information" means information about
    |
0008|     the genetic makeup of an individual or members of an
    |
0009|     individual's family resulting from genetic analysis, DNA
    |
0010|     composition,  participation in genetic research or use of
    |
0011|     genetic services;
    |
0012|               D.  "genetic propensity" means the presence in an
    |
0013|     individual or members of an individual's family of real or
    |
0014|     perceived variations in DNA or other genetic material from that
    |
0015|     of the normal genome that do not represent the outward
    |
0016|     physical, medical signs of a genetic disease at the time of
    |
0017|     consideration;      E.  "insurer" means a person who provides
    |
0018|     health insurance or life insurance; and
    |
0019|               F.  "person" means an individual or any other legal
    |
0020|     entity.
    |
0021|          Section 3.  DNA OWNERSHIP--RIGHTS OF OWNERSHIP--GENETIC
    |
0022|     ANALYSIS PROHIBITED WITHOUT PERMISSION OF OWNER.--
    |
0023|               A.  An individual's DNA, results derived from
    |
0024|     genetic analysis and genetic information are the property of
    |
0025|     the individual.
    |
0001|               B.  Except as provided in Subsection C of this
    |
0002|     section, genetic analysis of an individual and collection,
    |
0003|     retention, transmission or use of genetic information without
    |
0004|     the written informed consent of the individual or the
    |
0005|     individual's authorized representative is prohibited.
    |
0006|               C.  Genetic information and the results of genetic
    |
0007|     analysis may be obtained without the individual's written and
    |
0008|     informed consent only as authorized by law or rules of the
    |
0009|     department of public health:
    |
0010|                    (1)  to identify an individual in the course of
    |
0011|     a criminal investigation by a law enforcement agency;
    |
0012|                    (2)  to identify deceased individuals;
    |
0013|                    (3)  to establish parental identity; 
    |
0014|                    (4)  to screen newborns;
    |
0015|                    (5)  if the DNA, genetic analysis, results or
    |
0016|     genetic information is not identified with the individual or
    |
0017|     individual's family member; or
    |
0018|                    (6)  by a court for determination of damage
    |
0019|     awards pursuant to this subsection.
    |
0020|          Section 4.  GENETIC DISCRIMINATION PROHIBITED.--
    |
0021|     Discrimination by an insurer against an individual or member of
    |
0022|     the individual's family on the basis of genetic analysis for
    |
0023|     genetic propensity, susceptibility or carrier status for a
    |
0024|     disease or disorder or genetic information regarding the
    |
0025|     participation in genetic research or use of genetic services is
    |
0001|     prohibited.
    |
0002|          Section 5.  PENALTIES.--
    |
0003|               A.  The attorney general or district attorney may
    |
0004|     bring a civil action against a person for violating the
    |
0005|     provisions of the Genetic Information Privacy Act or to
    |
0006|     otherwise enforce those provisions.
    |
0007|               B.  An individual whose rights pursuant to the
    |
0008|     provisions of the Genetic Information Privacy Act have been
    |
0009|     violated may bring a civil action for damages or other relief.
    |
0010|               C.  The court may order a person who violates the
    |
0011|     provisions of the Genetic Information Privacy Act to comply
    |
0012|     with those provisions and may order other appropriate relief,
    |
0013|     including:
    |
0014|                    (1)  directing the person to provide a policy
    |
0015|     for hospital and medical expenses, including health insurance,
    |
0016|     group disability insurance or long-term-care coverage, to the
    |
0017|     injured individual under the same terms and conditions as would
    |
0018|     have applied had the violation not occurred;
    |
0019|                    (2)  damages for economic, bodily or emotional
    |
0020|     harm;
    |
0021|                    (3)  damages for economic losses sustained as a
    |
0022|     result of negligent violation of that act;
    |
0023|                    (4)  damages of up to five thousand dollars
    |
0024|     ($5,000) in addition to any economic loss if the violation
    |
0025|     results from willful or grossly negligent conduct; or
    |
0001|                    (5)  treble damages if the violation resulted
    |
0002|     in profit or monetary gain to the insurer or other person; and
    |
0003|                    (6)  if the plaintiff prevails, recovery of
    |
0004|     reasonable attorney fees and all appropriate court costs from
    |
0005|     the defendant.
    |
0006|               D.  Pursuant to Subsection C of Section 3 of the
    |
0007|     Genetic Information Privacy Act the court may use genetic
    |
0008|     information to determine the cause of damage or injury and
    |
0009|     penalty awards.
    |
0010|               E.  Each instance of collection, analysis,
    |
0011|     retention, disclosure or use of genetic information constitutes
    |
0012|     a separate and actionable violation of the Genetic Information
    |
0013|     Privacy Act.

0025|     individual's DNA, gene products or chromosomes that indicates a
    |
0001|     propensity for or susceptibility to illness, disease,
    |
0002|     impairment or other disorders, whether physical or mental, or
    |
0003|     that demonstrates genetic or chromosomal damage due to
    |
0004|     environmental factors, or carrier status for disease or
    |
0005|     disorder;
    |
0006|               D.  "genetic information" means information about
    |
0007|     the genetic makeup of an individual or members of an
    |
0008|     individual's family resulting from genetic analysis, DNA
    |
0009|     composition,  participation in genetic research or use of
    |
0010|     genetic services;
    |
0011|               E.  "genetic propensity" means the presence in an
    |
0012|     individual or members of an individual's family of real or
    |
0013|     perceived variations in DNA or other genetic material from that
    |
0014|     of the normal genome that do not represent the outward
    |
0015|     physical, medical signs of a genetic disease at the time of
    |
0016|     consideration;      F.  "insurer" means an insurance company,
    |
0017|     insurance service or insurance organization that is licensed to
    |
0018|     engage in the business of insurance in the state and that is
    |
0019|     subject to state law that regulates insurance within the
    |
0020|     meaning of Paragraph (2) of Subsection (b) of Section 514 of
    |
0021|     the federal Employee Retirement Income Security Act of 1974, as
    |
0022|     amended.  "Insurer" does not include an insurance company that
    |
0023|     is licensed under the Prepaid Dental Plan Law or a company that
    |
0024|     is solely engaged in the sale of dental insurance and is not
    |
0025|     licensed under that act, but under another provision of the New
    |
0001|     Mexico Insurance Code; and
    |
0002|               G.  "person" means an individual or any other legal
    |
0003|     entity.
    |
0004|          Section 3. GENETIC ANALYSIS PROHIBITED WITHOUT INFORMED
    |
0005|     CONSENT--EXCEPTIONS.--
    |
0006|               A.  Except as provided in Subsection C of this section,
    |
0007|     no person shall obtain genetic information or samples for genetic
    |
0008|     analysis from an individual without first obtaining informed
    |
0009|     consent from the individual or the individual's authorized
    |
0010|     representative.
    |
0011|               B.  Except as provided in Subsection C of this section,
    |
0012|     genetic analysis of an individual and collection, retention,
    |
0013|     transmission or use of genetic information without the written
    |
0014|     informed consent of the individual or the individual's authorized
    |
0015|     representative is prohibited.
    |
0016|               C.  An individual's DNA or genetic information or the
    |
0017|     results of genetic analysis may be obtained or retained without
    |
0018|     the individual's written and informed consent only as authorized
    |
0019|     by law or rules of the department of health:
    |
0020|                    (1)  to identify an individual in the course of a
    |
0021|     criminal investigation by a law enforcement agency;
    |
0022|                    (2)  if the individual has been convicted of a
    |
0023|     felony and is in the custody of the corrections department, for
    |
0024|     purposes of maintaining a DNA database for law enforcement
    |
0025|     purposes;
    |
0001|                    (3)  to identify deceased individuals;
    |
0002|                    (4)  to establish parental identity; 
    |
0003|                    (5)  to screen newborns;
    |
0004|                    (6)  if the DNA, genetic analysis, results or
    |
0005|     genetic information is not identified with the individual or
    |
0006|     individual's family member;
    |
0007|                    (7)  by a court for determination of damage
    |
0008|     awards pursuant to this subsection;
    |
0009|                    (8)  by medical repositories or registries, as
    |
0010|     authorized by federal or state law or regulation;
    |
0011|                    (9)  for the purpose of medical or scientific
    |
0012|     research and education, including retention of genetic analysis,
    |
0013|     information, results and tissues, where the identity of
    |
0014|     individuals or individuals' family members will not be disclosed;
    |
0015|     or
    |
0016|                    (10)  for the purpose of emergency medical
    |
0017|     treatment consistent with applicable law.
    |
0018|               D.  Actions of an insurer and third parties dealing
    |
0019|     with an insurer in the ordinary course of conducting and
    |
0020|     administering the business of life, disability income or long-term
    |
0021|     care insurance are exempt from the provisions of this section. 
    |
0022|     However, before or at the time of collecting genetic information
    |
0023|     for use in conducting and administering life, disability income or
    |
0024|     long-term care insurance, the insurer shall notify in writing an
    |
0025|     applicant for insurance or the insured that the information may be
    |
0001|     used, transmitted or retained.
    |
0002|          Section 4.  GENETIC DISCRIMINATION PROHIBITED.--            
    |
0003|               A.  Discrimination by an insurer against an individual
    |
0004|     or member of the individual's family on the basis of genetic
    |
0005|     analysis for genetic propensity, susceptibility or carrier status
    |
0006|     for a disease or disorder or genetic information regarding the
    |
0007|     participation in genetic research or use of genetic services is
    |
0008|     prohibited.  No insurer shall use any genetic analysis or any
    |
0009|     genetic information for any purpose other than in the ordinary
    |
0010|     conduct of business in connection with life, disability income or
    |
0011|     long-term care insurance.
    |
0012|               B.  The provisions of this section do not require a
    |
0013|     health insurer to provide particular benefits other than those
    |
0014|     provided under the terms of the plan or coverage or prevent the
    |
0015|     plan or coverage from establishing limitations or restrictions on
    |
0016|     the amount, level, extent or nature of the benefits or coverage
    |
0017|     for similarly situated individuals.  Individuals are similarly
    |
0018|     situated if they have manifested similar physical or mental
    |
0019|     conditions whether or not they have genetic propensity,
    |
0020|     susceptibility or carrier status.  A health insurer shall not
    |
0021|     consider a genetic propensity, susceptibility or carrier status as
    |
0022|     a preexisting condition for the purpose of limiting or excluding
    |
0023|     benefits in the absence of a diagnosis of the condition related to
    |
0024|     or resulting from the genetic propensity, susceptibility or
    |
0025|     carrier status.
    |
0001|               C.  The provisions of this section do not prohibit use
    |
0002|     of any genetic analysis of any genetic information by an insurer
    |
0003|     in the ordinary conduct of business in connection with life,
    |
0004|     disability income or long-term care insurance, provided that any
    |
0005|     underwriting action taken in connection with life, disability
    |
0006|     income or long-term care insurance on the basis of any genetic
    |
0007|     analysis or any genetic information is based on sound actuarial
    |
0008|     principles or related to actual or reasonably anticipated
    |
0009|     experience.
    |
0010|          Section 5.  PENALTIES.--
    |
0011|               A.  The attorney general or district attorney may bring
    |
0012|     a civil action against a person for violating the provisions of
    |
0013|     the Genetic Information Privacy Act or to otherwise enforce those
    |
0014|     provisions. 
    |
0015|               B.  An individual whose rights pursuant to the
    |
0016|     provisions of the Genetic Information Privacy Act have been
    |
0017|     violated may bring a civil action for damages or other relief.
    |
0018|               C.  The court may order a person who violates the
    |
0019|     provisions of the Genetic Information Privacy Act to comply with
    |
0020|     those provisions and may order other appropriate relief,
    |
0021|     including:
    |
0022|                    (1)  directing an insurer to provide a policy for
    |
0023|     hospital and medical expenses, including health insurance, group
    |
0024|     disability insurance or long-term-care coverage, to the injured
    |

    |
0009|                    (5)  if the plaintiff prevails, recovery of
    |
0010|     reasonable attorney fees and all appropriate court costs from the
    |
0011|     defendant.
    |
0012|               D.  Pursuant to Subsection C of Section 3 of the
    |
0013|     Genetic Information Privacy Act, the court may use genetic
    |
0014|     information to determine the cause of damage or injury and penalty
    |
0015|     awards.
    |
0016|               E.  Each instance of collection, analysis, retention,
    |
0017|     disclosure or use of genetic information constitutes a separate
    |
0018|     and actionable violation of the Genetic Information Privacy Act.
    |
0019|          Section 6.  RIGHTS OF RETENTION.--
    |
0020|               A.  Unless otherwise authorized by Subsection C of
    |
0021|     Section 3 of the Genetic Information Privacy Act, no person shall
    |
0022|     retain an individual's genetic information, gene product or
    |
0023|     samples for genetic analysis without first obtaining informed
    |
0024|     consent from the individual or the individual's authorized
    |
0025|     representative.  This subsection does not affect the status of
    |
0001|     original medical records of individual patients and the rules of
    |
0002|     confidentiality and accessibility applicable to thee records
    |
0003|     continue in force.
    |
0004|               B.  An individual's genetic information or samples for
    |
0005|     genetic analysis shall be destroyed promptly upon the specific
    |
0006|     request of that individual or that individual's authorized
    |
0007|     representative, unless:
    |
0008|                    (1)  retention is necessary for the purposes of a
    |
0009|     criminal or death investigation or a criminal or juvenile
    |
0010|     proceeding;
    |
0011|                    (2)  retention is authorized by order of a court
    |
0012|     of competent jurisdiction; 
    |
0013|                    (3)  retention is authorized under a research
    |
0014|     protocol approved by an institutional review board pursuant to
    |
0015|     federal law or a medical registry or repository authorized by
    |
0016|     state or federal law; or
    |
0017|                    (4)  the genetic information or samples for
    |
0018|     genetic analysis have been obtained pursuant to Subsection C of
    |
0019|     Section 3 of the Genetic Information Privacy Act.
    |
0020|               C.  Actions of an insurer and third parties dealing
    |
0021|     with an insurer in the ordinary course of conducting and
    |
0022|     administering the business of life, disability income or long-term
    |
0023|     care insurance are exempt from the provisions of this section. 
    |
