    |
0011|     RELATING TO MOTOR VEHICLE RECORDS; ALLOWING CERTAIN ATTORNEYS
    |
0012|     TO HAVE ACCESS TO MOTOR VEHICLE RECORDS.

    |
0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 66-2-7.1 NMSA 1978 (being Laws 1995,
    |
0016|     Chapter 135, Section 4) is amended to read:
    |
0017|          "66-2-7.1.  MOTOR VEHICLE-RELATED RECORDS--CONFIDENTIAL.--
    |
0018|               A.  It is unlawful for any department employee or
    |
0019|     contractor or for any former department employee or contractor
    |
0020|     to disclose to any person other than another employee of the
    |
0021|     department any personal information about an individual
    |
0022|     obtained by the department in connection with a driver's
    |
0023|     license or permit, the titling or registration of a vehicle or
    |
0024|     an identification card issued by the department pursuant to the
    |
0025|     Motor Vehicle Code except:
    |
0001|                    (1)  to the individual or the individual's
    |
0002|     authorized representative;
    |
0003|                    (2)  for use by [any] a governmental
    |
0004|     agency, including any court, in carrying out its functions or
    |
0005|     by [any] a private person acting on behalf of the
    |
0006|     government;
    |
0007|                    (3)  for use in connection with matters of
    |
0008|     motor vehicle and driver safety or theft; motor vehicle
    |
0009|     emissions; performance monitoring of motor vehicles, motor
    |
0010|     vehicle parts and dealers; motor vehicle market research
    |
0011|     activities, including survey research; motor vehicle production
    |
0012|     alterations, recalls or advisories and removal of non-owner
    |
0013|     records from original owner records of motor vehicle
    |
0014|     manufacturers;
    |
0015|                    (4)  for use in research activities and for use
    |
0016|     in producing statistical reports so long as the personal
    |
0017|     information is not published, redisclosed or used to contact
    |
0018|     individuals;
    |
0019|                    (5)  for use by [any] an attorney
    |
0020|     representing a person having a claim against another person,
    |
0021|     insurer, [or] insurance support organization or [by a]
    |
0022|     self-insured entity, or [its] the agents, employees or
    |
0023|     contractors of the attorney, insurer, insurance support
    |
0024|     organization or self-insured entity, in connection with claims
    |
0025|     investigation activities, antifraud activities, rating or
    |
0001|     underwriting;
    |
0002|                    (6)  for providing notice to owners of towed or
    |
0003|     impounded vehicles;
    |
0004|                    (7)  for use by an employer or its agent or
    |
0005|     insurer in obtaining or verifying information relating to a
    |
0006|     holder of a commercial driver's license; 
    |
0007|                    (8)  for use by any requester if the requester
    |
0008|     demonstrates that it has obtained the written consent of the
    |
0009|     individual to whom the information pertains; or
    |
0010|                    (9)  for any use in response to requests for
    |
0011|     individual motor vehicle records if the department has provided
    |
0012|     in a clear and conspicuous manner on forms for issuance or
    |
0013|     renewal of operator's permits, titles, registrations or
    |
0014|     identification cards notice that personal information collected
    |
0015|     by the department may be disclosed to any person and the
    |
0016|     department has provided in a clear and conspicuous manner on
    |
0017|     such forms an opportunity to prohibit such disclosures.
    |
0018|               B.  Any person who violates the provisions of this
    |
0019|     section is guilty of a misdemeanor and upon conviction
    |
0020|     [thereof] shall be punished in accordance with the provisions
    |
0021|     of Section 31-19-1 NMSA 1978."

0023|   through "any" and delete the underscored language.
    |

0025|        3.  On page 2, line 20, after "contractors" strike the
    |
0001|   remainder of the line and strike all of line 21.

0003|        4.  On page 2, between lines 23 and 24, insert the following

0004|   new paragraphs:

    |

    |

0019|   personal information submitted by a person to the bank, savings
    |
0020|   and loan association, savings bank or credit union; and
    |

0022|                                 (b)  if the information as
    |
0023|   submitted is not correct or is no longer correct, to obtain the
    |
0024|   correct information, but only for the purposes of preventing
    |
0025|   fraud by, pursuing legal remedies against or recovering on a debt
    |
0001|   or security interest against the person;".

0003|        5.  Renumber the succeeding paragraphs accordingly.,
