0011|     RELATING TO PHARMACISTS; ENACTING A NEW SECTION OF THE NMSA

0012|     1978 TO PERMIT INSURANCE COVERAGE FOR PATIENT COUNSELING

0013|     SERVICES BY PHARMACISTS.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of Chapter 59A, Article 22 NMSA
    |
0017|     1978 is enacted to read: 
    |
0018|          "[NEW MATERIAL]  COVERAGE FOR PATIENT COUNSELING BY
    |
0019|     PHARMACISTS.--
    |
0020|               A.  Each individual and group health insurance
    |
0021|     policy, health care plan, pharmaceutical plan and certificate
    |
0022|     of health insurance delivered or issued for delivery in this
    |
0023|     state that offers coverage for service within the scope of
    |
0024|     practice of a duly licensed pharmacist, including patient
    |
0025|     counseling on prescription drugs, may pay or reimburse the cost
    |
0001|     of the service performed by a pharmacist. 
    |
0002|              B.  Payment or reimbursement may be made pursuant to
    |
0003|     this section for a service performed by a duly licensed
    |
0004|     pharmacist when:
    |
0005|                    (1)  the service performed is within the lawful
    |
0006|     scope of practice of the pharmacist; and
    |
0007|                    (2)  the coverage provides for reimbursement
    |
0008|     for identical services performed by other licensed health care
    |
0009|     providers.
    |
0010|               C.  Nothing in this section shall require the plan
    |
0011|     to pay a claim to more than one provider for duplicate service
    |
0012|     or be interpreted to limit physician reimbursement."
