0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0012| SEVERANCE TAX BONDS FOR IMPROVEMENTS TO VARIOUS TAOS PUBLIC
|
0013| SCHOOLS; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. SEVERANCE TAX BONDS--PURPOSE FOR WHICH ISSUED-
|
0017| -APPROPRIATION OF PROCEEDS.--
|
0018| A. The state board of finance may issue and sell
|
0019| severance tax bonds in compliance with the Severance Tax
|
0020| Bonding Act in an amount not exceeding five million three
|
0021| hundred sixty thousand four hundred dollars ($5,360,400) when
|
0022| the state department of public education certifies the need for
|
0023| the issuance of the bonds. The state board of finance shall
|
0024| schedule the issuance and sale of the bonds in the most
|
0025| expeditious and economical manner possible upon a finding by
|
0001| the board that the project has been developed sufficiently to
|
0002| justify the issuance and that the project can proceed to
|
0003| contract within a reasonable time. The state board of finance
|
0004| shall further take the appropriate steps necessary to comply
|
0005| with the Internal Revenue Code of 1986, as amended. The
|
0006| proceeds from the sale of the bonds are appropriated to the
|
0007| state department of public education in the following amounts
|
0008| for expenditure in the Taos school district public schools
|
0009| located in Taos county for the following purposes:
|
0010| (1) six hundred fifty thousand dollars
|
0011| ($650,000) for site and approach road improvements at the
|
0012| Northside elementary school;
|
0013| (2) two hundred fifty thousand dollars
|
0014| ($250,000) for improvements to the wastewater system, including
|
0015| a new traditional or wetland treatment facility, at the
|
0016| Northside elementary school;
|
0017| (3) two hundred fifty thousand dollars
|
0018| ($250,000) for building improvements, including a walkway
|
0019| portal and purchase and installation of various equipment, at
|
0020| the Northside elementary school;
|
0021| (4) seven hundred eighty-six thousand six
|
0022| hundred dollars ($786,600) for planning, designing,
|
0023| constructing and equipping six new classrooms and necessary
|
0024| storage and sanitary facilities at Taos high school;
|
0025| (5) five hundred thirteen thousand dollars
|
0001| ($513,000) for repairs to the roof and canales and related
|
0002| drainage landscaping and various remodeling and renovation
|
0003| necessary to comply with the federal Americans with
|
0004| Disabilities Act of 1990 at Taos junior high school;
|
0005| (6) four hundred seventy thousand eight
|
0006| hundred dollars ($470,800) for planning, designing,
|
0007| constructing and equipping or purchasing, installing and
|
0008| equipping two permanent kindergarten classrooms and one music
|
0009| classroom and for various landscaping improvements at the
|
0010| Ranchos de Taos elementary school; and
|
0011| (7) two million four hundred forty thousand
|
0012| dollars ($2,440,000) for planning, designing, constructing and
|
0013| equipping or purchasing, installing and equipping four
|
0014| classrooms, six therapy rooms and a cafeteria and for various
|
0015| remodeling and renovation projects, including work necessary
|
0016| for compliance with the federal Americans with Disabilities Act
|
0017| of 1990, in Taos elementary school and Enos Garcia middle
|
0018| school.

0019| B. If the state department of public education has
|
0020| not certified the need for the issuance of the bonds by the end
|
0021| of fiscal year 1999, the authorization provided in this section
|
0022| shall be void. Any unexpended or unencumbered balance
|
0023| remaining from the proceeds of severance tax bonds issued
|
0024| pursuant to Subsection A of this section at the end of fiscal
|
0025| year 2000 shall revert to the severance tax bonding fund.

0001| Section 2. EMERGENCY.--It is necessary for the public
|
0002| peace, health and safety that this act take effect immediately.
