0014|     PROCESSORS FROM REGULATION PURSUANT TO THE FOOD SERVICE

0015|     SANITATION ACT.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 25-1-2 NMSA 1978 (being Laws 1977,
    |
0019|     Chapter 309, Section 2, as amended) is amended to read:
    |
0020|          "25-l-2.  DEFINITIONS.--As used in the Food Service
    |
0021|     Sanitation Act:
    |
0022|               A.  "agency" or "division" means the department of
    |
0023|     environment;
    |
0024|               B.  "board" means the environmental improvement
    |
0025|     board;
    |
0001|               C.  "employee" means any individual employed in a
    |
0002|     food service establishment who transports food or food
    |
0003|     containers, who handles food during storage, preparation or
    |
0004|     serving, who comes in contact with any utensils or who is
    |
0005|     employed in a room in which food is stored, prepared or served;
    |
0006|               D.  "food" means any solid or liquid substance
    |
0007|     intended for human consumption by eating or drinking;
    |
0008|               E.  "general public" includes beneficiaries of
    |
0009|     governmental feeding programs and private charitable feeding
    |
0010|     programs and residents and employees of institutions that
    |
0011|     provide meals to their residents and employees either with or
    |
0012|     without direct payment to the institution by the residents or
    |
0013|     employees;
    |
0014|               F.  "temporary food service establishment" means a
    |
0015|     food service establishment that operates at a fixed location in
    |
0016|     conjunction with a single event or celebration for a short
    |
0017|     period of time not exceeding the event or celebration or not
    |
0018|     exceeding thirty days;
    |
0019|               G.  "person" means an individual or any other legal
    |
0020|     entity;
    |
0021|               H.  "food service establishment" means:
    |
0022|                    (1)  any fixed or mobile place where food is
    |
0023|     served and sold for consumption on the premises;
    |
0024|                    (2)  any fixed or mobile place where food is
    |
0025|     prepared for sale to or consumption by the general public
    |
0001|     either on or off the premises, including any place where food
    |
0002|     is manufactured for ultimate sale in a sealed original package,
    |
0003|     but "prepared" as used in this paragraph does not include the
    |
0004|     preparation of raw fruits and vegetables for display and sale
    |
0005|     in a grocery store or similar operation.  "Food service
    |
0006|     establishment" does not mean dairy establishment, <u>meat
</u>    |
<u></u>0007| <u>    wholesale establishment, jerky establishment or poultry
</u>    |
<u></u>0008| <u>    processor</u>; and
    |
0009|                    (3)  meat markets, whether or not operated in
    |
0010|     conjunction with a grocery store;
    |
0011|               I.  "utensil" means any implement used in the
    |
0012|     storage, preparation, transportation or service of food; and
    |
0013|               J.  "dairy establishment" means a milk processing or
    |
0014|     milk producing facility."
