0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0015| Section 1. VOLUNTEERS--CIVIL LIABILITY IMMUNITY.--No
|
0016| unpaid worker who works on behalf of nonprofit organizations
|
0017| shall be held liable for civil damages as a result of an action
|
0018| or omission by that person, except for gross negligence;
|
0019| provided that nothing herein shall apply to work rendered for
|
0020| remuneration or with the expectation of remuneration or
|
0021| rendered by a person soliciting business or performing services
|
0022| for remuneration.

0013| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0014| Section 1. VOLUNTEERS--CIVIL LIABILITY IMMUNITY.--
|
0015| A. No unpaid worker who works on behalf of
|
0016| nonprofit organizations shall be held liable for civil damages
|
0017| as a result of an action or omission by that person, except for
|
0018| negligence; provided that nothing herein shall apply to work
|
0019| rendered for remuneration or with the expectation of
|
0020| remuneration or rendered by a person soliciting business or
|
0021| performing services for remuneration nor shall this section
|
0022| apply to workers who are handling money for the organization.
|
0023| B. No nonprofit organization shall be held liable
|
0024| for civil damages as a result of an action or omission by any
|
0025| unpaid worker that works on behalf of that organization except
|
0001| if the board of directors was aware of a wrongful act of that
|
0002| employee and failed to prevent that action.
