0011|     RELATING TO MOTOR VEHICLES; ESTABLISHING REQUIREMENTS FOR
    |
0012|     SUN SCREENING MATERIAL; AMENDING AND ENACTING SECTIONS OF
    |
0013|     THE NMSA 1978.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW
    |
0016|     MEXICO:
    |
0017|          Section 1.  Section 66-3-846 NMSA 1978 (being Laws
    |
0018|     1978, Chapter 35, Section 152) is amended to read:
    |
0019|          "66-3-846.  WINDSHIELDS MUST BE UNOBSTRUCTED AND
    |
0020|     EQUIPPED WITH WIPERS--WINDOWS MUST BE TRANSPARENT--
    |
0021|     EXCEPTION.--
    |
0022|               A.  No person shall drive any motor vehicle with
    |
0023|     any sign, poster or other nontransparent material upon or
    |
0024|     in the front windshield, windows to the immediate right
    |
0025|     and left of the driver or in the rearmost window if the
    |
0001|     latter is used for driving visibility, except as provided
    |
0002|     in Section 66-3-846.1 NMSA 1978.  The rearmost window is
    |
0003|     not necessary for driving visibility where outside
    |
0004|     rearview mirrors are attached to the vehicle.
    |
0005|               B.  The windshield on every motor vehicle except
    |
0006|     a motorcycle shall be equipped with a device for cleaning
    |
0007|     rain, snow or other moisture from the windshield, which
    |
0008|     device shall be so constructed as to be controlled or
    |
0009|     operated by the driver of the vehicle.
    |
0010|               C.  Every windshield wiper upon a motor vehicle
    |
0011|     shall be maintained in good working order."
    |
0012|          Section 2.  A new section of the Motor Vehicle Code,
    |
0013|     Section 66-3-846.1 NMSA 1978, is enacted to read:
    |
0014|          "66-3-846.1.  [NEW MATERIAL]  SUN SCREENING
    |
0015|     MATERIAL ON WINDSHIELDS AND WINDOWS--REQUIREMENTS--
    |
0016|     VIOLATION--PENALTY.--
    |
0017|               A.  A person shall not operate on any street or
    |
0018|     highway a motor vehicle that is registered or required to
    |
0019|     be registered in this state if that motor vehicle has a
    |
0020|     sun screening material on the windshield or any window
    |
0021|     that does not comply with the requirements of this
    |
0022|     section.
    |
0023|               B.  Except as otherwise provided in this
    |
0024|     section, a sun screening material:
    |
0025|                    (1)  when used in conjunction with the
    |
0001|     windshield, shall be nonreflective, shall not be red,
    |
0002|     yellow or amber in color and shall be used only along the
    |
0003|     top of the windshield, not extending downward beyond the
    |
0004|     ASI line or more than five inches from the top of the
    |
0005|     windshield, whichever is closer to the top of the
    |
0006|     windshield; and 
    |
0007|                    (2)  when used in conjunction with the
    |
0008|     safety glazing materials of the side wings or side windows
    |
0009|     located at the immediate right and left of the driver, the
    |
0010|     side windows behind the driver and the rearmost window
    |
0011|     shall be nonreflective, shall have a light transmission of
    |
0012|     not less than twenty percent and shall be used only on the
    |
0013|     windows of a motor vehicle equipped with one right and one
    |
0014|     left outside rearview mirror.
    |
0015|               C.  Each manufacturer shall:
    |
0016|                    (1)  certify to the division that a sun
    |
0017|     screening material used by that manufacturer is in
    |
0018|     compliance with the nonreflectivity and light transmission
    |
0019|     requirements of this section;
    |
0020|                    (2)  provide a label not to exceed one and
    |
0021|     one-half square inches in size that:
    |
0022|                         (a)  is installed permanently and
    |
0023|     legibly between the sun screening material and each
    |
0024|     glazing surface to which it is applied;
    |
0025|                         (b)  contains the manufacturer's name,
    |
0001|     the date that the sun screening material was manufactured
    |
0002|     and the percentage of light transmission; and
    |
0003|                         (c)  is placed in the left lower
    |
0004|     corner of each glazing surface when facing the motor
    |
0005|     vehicle from the outside; and
    |
0006|                    (3)  include instructions with the sun
    |
0007|     screening material for proper installation, including the
    |
0008|     affixing of the label specified in this subsection.
    |
0009|               D.  No person shall:
    |
0010|                    (1)  offer for sale or for use any sun
    |
0011|     screening material for motor vehicle use not in compliance
    |
0012|     with this section; or
    |
0013|                    (2)  install any sun screening material on
    |
0014|     motor vehicles intended for operation on any street or
    |
0015|     highway without permanently affixing the label specified
    |
0016|     in Subsection C of this section.
    |
0017|               E.  The provisions of this section do not apply
    |
0018|     to a motor vehicle registered in this state in the name of
    |
0019|     a person, or the person's legal guardian, who has an
    |
0020|     affidavit signed by a physician or an optometrist licensed
    |
0021|     to practice in this state that states that the person has
    |
0022|     a physical condition that makes it necessary to equip the
    |
0023|     motor vehicle with sun screening material that is in
    |
0024|     violation of this section.  The affidavit shall be in the
    |
0025|     possession of the person with such a physical condition,
    |
0001|     or the person's legal guardian, at all times while being
    |
0002|     transported in the motor vehicle.
    |
0003|               F.  The light transmission requirement of this
    |
0004|     section does not apply to windows behind the driver on
    |
0005|     trucks, buses, recreational vehicles and motor homes.
    |
0006|               G.  The provisions of this section do not apply
    |
0007|     to motor vehicles that have sun screening material on the
    |
0008|     windshield or any window prior to the effective date of
    |
0009|     this section.
    |
0010|               H.  As used in this section:
    |
0011|                    (1)  "light transmission" means the ratio
    |
0012|     of the amount of total light that passes through a product
    |
0013|     or material, expressed in percentages, to the amount of
    |
0014|     the total light falling on the product or material;
    |
0015|                    (2)  "manufacturer" means any person
    |
0016|     engaged in the manufacturing or assembling of sun
    |
0017|     screening products or materials designed to be used in
    |
0018|     conjunction with motor vehicle glazing materials for the
    |
0019|     purpose of reducing the effects of the sun;
    |
0020|                    (3)  "nonreflective" means designed to
    |
0021|     absorb light rather that to reflect it; and
    |
0022|                    (4)  "sun screening material" means any
    |
0023|     film material, substance, device or product that is
    |
0024|     designed to be used in conjunction with motor vehicle
    |
0025|     safety glazing materials for reducing the effects of the
    |
0001|     sun.
    |
0002|               I.  Any person who violates any provision of
    |
0003|     this section is guilty of a petty misdemeanor and upon
    |
0004|     conviction shall be punished by a fine of not more than
    |
0005|     seventy-five dollars ($75.00)."
    |
0006|          Section 3.  EFFECTIVE DATE.--The effective date of
    |
