KING | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO PUBLIC UTILITIES; ENACTING A NEW SECTION OF THE | 0012| NMSA 1978 TO AUTHORIZE THE NEW MEXICO PUBLIC UTILITY COMMISSION | 0013| TO PERMIT RETAIL WHEELING. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. A new section of Chapter 62, Article 6 NMSA | 0017| 1978 is enacted to read: | 0018| "[NEW MATERIAL] RETAIL WHEELING PERMITTED--AUTHORITY OF | 0019| COMMISSION.-- | 0020| A. The intent and purpose of this section is to | 0021| permit and encourage retail wheeling in the electric utility | 0022| industry without impairing the provision of electric service to | 0023| the state's residents. The commission may, by rule or order, | 0024| authorize the nondiscriminatory and nonpreferential retail | 0025| wheeling of electricity by any person subject to its | 0001| jurisdiction. | 0002| B. The commission may, in its discretion, impose | 0003| such terms and conditions on permitted retail wheeling as may | 0004| be necessary to safeguard the adequacy, reliability and | 0005| efficiency of electric service and to prevent undue hardship to | 0006| or anticompetitive conduct by or on persons subject to its | 0007| jurisdiction. | 0008| C. The rates and charges for the permitted retail | 0009| wheeling of electricity shall be just, reasonable, | 0010| nondiscriminatory and subject to the approval of the | 0011| commission. | 0012| D. The commission shall by rule or order adopt | 0013| directives, standards, forms and reporting requirements to | 0014| effectuate this section. | 0015| E. The commission shall ensure that benefits | 0016| available from retail wheeling accrue to electricity consumers | 0017| as may be reasonably and equitably practical. | 0018| F. The commission shall conduct public hearings on | 0019| any order or rule implementing retail wheeling in the electric | 0020| utility industry to determine all legitimate and verifiable | 0021| transition costs. The commission shall identify the transition | 0022| costs of each person subject to its jurisdiction and shall | 0023| report to the legislature before December 15, 1997 its findings | 0024| and recommendations, by person, relating to the amount and | 0025| recovery of transition costs. | 0001| G. Nothing in this section shall alter or modify | 0002| the authority of the commission to regulate the rates and | 0003| services of a person otherwise subject to its jurisdiction." | 0004|  |
