0011| AUTHORIZING LOCAL SCHOOL BOARDS TO GRANT HIGH SCHOOL DIPLOMAS
|
0012| TO STUDENTS WHO FULFILL INDIVIDUALIZED EDUCATION PROGRAMS;
|
0013| DECLARING AN EMERGENCY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 22-2-8.4 NMSA 1978 (being Laws 1986,
|
0017| Chapter 33, Section 5, as amended by Laws 1995, Chapter 174,
|
0018| Section 1 and also by Laws 1995, Chapter 180, Section 1) is
|
0019| amended to read:
|
0020| "22-2-8.4. GRADUATION REQUIREMENTS.--
|
0021| A. At the end of the eighth grade or during the
|
0022| ninth grade, each student shall prepare an individual program
|
0023| of study for grades nine through twelve. The program of study
|
0024| shall be signed by a student's parent or guardian.
|
0025| B. Beginning with students entering the ninth grade
|
0001| in the 1986-87 school year, successful completion of a minimum
|
0002| of twenty-three units shall be required for graduation. These
|
0003| units shall be as follows:
|
0004| (1) four units in English, with major emphasis
|
0005| on grammar and literature;
|
0006| (2) three units in mathematics;
|
0007| (3) two units in science, one of which shall
|
0008| have a laboratory component;
|
0009| (4) three units in social science, which shall
|
0010| include United States history and geography, world history and
|
0011| geography and government and economics;
|
0012| (5) one unit in physical fitness;
|
0013| (6) one unit in communication skills, with
|
0014| major emphasis on writing and speaking, which may include a
|
0015| language other than English; and
|
0016| (7) nine elective units. Only the following
|
0017| elective units shall be counted toward meeting the requirements
|
0018| for graduation: fine arts, [i.e.] including music, band,
|
chorus and art; practical arts; physical education; languages
|
other than English; speech; drama; vocational education;
|
mathematics; science; English; [R.O.T.C.] reserve officer
|
0022| training corps; social science; computer science; health
|
0023| education; and other electives approved by the state board.
|
0024| With the approval of the local school board, participation
|
0025| on an athletic team or in an athletic sport during the school
|
0001| day may count toward fulfillment of the physical education
|
0002| required unit.
|
0003| C. Final examinations shall be administered to all
|
0004| students in all classes offered for credit.
|
0005| D. [Beginning with students entering the ninth
|
grade in the 1986-87 school year] Except as provided in
|
0007| Subsection E, no student shall receive a high school diploma
|
0008| who has not passed a state competency examination in the
|
0009| subject areas of reading, English, math, science and social
|
0010| science. Beginning with the 1997-98 school year, the state
|
0011| competency examinations on social science shall include a
|
0012| section on the constitution of the United States and the
|
0013| constitution of New Mexico. If a student exits from the
|
0014| school system at the end of grade twelve without having passed
|
0015| a state competency examination, he shall receive an appropriate
|
0016| state certificate indicating the number of credits earned and
|
0017| the grade completed. If within five years after a student
|
0018| exits from the school system he takes and passes the state
|
0019| competency examination, he may receive a high school diploma.
|
0020| E. A student who receives special education
|
0021| services and who has fulfilled the goals and objectives or
|
0022| course work set forth in his individualized education program
|
0023| shall, upon the recommendation of the individualized education
|
0024| committee, receive a high school diploma.
|
0025| [E.] F. The state board may establish a policy
|
0001| to provide for administrative interpretations to clarify
|
0002| curricular and testing provisions of the Public School Code."
|
0003| Section 2. EMERGENCY.--It is necessary for the public
|
0004| peace, health and safety that this act take effect immediately.
