A new section of Chapter 12, Article 2 NMSA | 0017| 1978 is enacted to read: | 0018| "[NEW MATERIAL] INDIAN COUNTRY--DEFINITION FOR PURPOSES | 0019| OF THE STATUTES.--When used in the statutes, "Indian country" | 0020| means: | 0021| A. all land within the limits of any reservation of | 0022| an Indian nation, tribe or pueblo under the jurisdiction of the | 0023| United States government, notwithstanding the issuance of any | 0024| patent and including rights of way running through the | 0025| reservation; | 0001| B. all dependent Indian communities within the | 0002| borders of New Mexico whether within the original or | 0003| subsequently acquired territory; | 0004| C. all Indian allotments, the Indian titles to | 0005| which have not been extinguished, including rights of way | 0006| running through the allotments; and | 0007| D. any lands, title to which is either held by the | 0008| United States in trust for the benefit of any Indian nation, | 0009| tribe, pueblo or tribal member or is held by any Indian nation, | 0010| tribe, pueblo or tribal member subject to a restriction by the | 0011| United States against alienation." | 0012| Section 2.
