A new section of the New Mexico Insurance Code | 0018| is enacted to read: | 0019| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as | 0020| the "Insurance Fraud Act"." | 0021| Section 2. A new section of the New Mexico Insurance Code | 0022| is enacted to read: | 0023| "[NEW MATERIAL] FINDINGS--PURPOSE.-- | 0024| A. The legislature finds that insurance fraud is | 0025| pervasive and expensive, and has the potential for increasing | 0001| premium rates, placing businesses at risk, reducing the ability | 0002| of consumers to raise their standard of living and decreasing | 0003| the economic vitality of this state. Therefore, the | 0004| legislature believes that the state must aggressively confront | 0005| the problem of insurance fraud. | 0006| B. The purpose of the Insurance Fraud Act is to | 0007| permit the full utilization of the expertise of the | 0008| superintendent of insurance to investigate and detect insurance | 0009| fraud more effectively, to halt insurance fraud and to assist | 0010| and receive assistance from state, local and federal law | 0011| enforcement and regulatory agencies in enforcing prohibitions | 0012| against the commission of insurance fraud." | 0013| Section 3. A new section of the New Mexico Insurance Code | 0014| is enacted to read: | 0015| "[NEW MATERIAL] DEFINITIONS.--As used in the Insurance | 0016| Fraud Act: | 0017| A. "bureau" means the insurance fraud bureau; | 0018| B. "fund" means the insurance fraud fund; | 0019| C. "insurance fraud" means any act or practice in | 0020| connection with an insurance transaction that constitutes a | 0021| crime under the Criminal Code or the Insurance Code; and | 0022| D. "insurance transaction" means any act or | 0023| practice relating to insurance and includes complying with the | 0024| Insurance Code or any rule or regulation adopted under its | 0025| authority." | 0001| Section 4. A new section of the New Mexico Insurance Code | 0002| is enacted to read: | 0003| "[NEW MATERIAL] INSURANCE FRAUD BUREAU--CREATION.-- | 0004| There is created within the department of insurance an | 0005| "insurance fraud bureau". The purpose of the bureau includes | 0006| investigating suspected insurance fraud. The superintendent | 0007| shall appoint the full-time supervisory and investigative | 0008| personnel of the bureau, who shall be qualified by training and | 0009| experience to perform the duties of their positions. The | 0010| superintendent shall also appoint clerical and other staff | 0011| necessary for the bureau to carry out its duties and | 0012| responsibilities under the Insurance Fraud Act." | 0013| Section 5. A new section of the New Mexico Insurance Code | 0014| is enacted to read: | 0015| "[NEW MATERIAL] INSURANCE FRAUD BUREAU--DUTIES.--The | 0016| bureau shall: | 0017| A. initiate inquiries and conduct investigations | 0018| when the bureau has reason to believe that insurance fraud may | 0019| have been or is being committed; | 0020| B. respond to notifications or complaints of | 0021| suspected insurance fraud generated by state and local police, | 0022| other law enforcement authorities and governmental units, | 0023| including the federal government and any other person; | 0024| C. review notices and reports of insurance fraud | 0025| submitted by authorized insurers, their employees, agents or | 0001| producers and select those incidents of alleged fraud that, in | 0002| its judgment, require further investigation and conduct the | 0003| investigation; | 0004| D. conduct independent investigations and | 0005| examinations of insurance transactions and alleged insurance | 0006| fraud, conduct studies to determine the extent of insurance | 0007| fraud, deceit or intentional misrepresentation of any kind in | 0008| the insurance process and publish information and reports on | 0009| its examinations and studies; | 0010| E. report incidents of alleged insurance fraud | 0011| supported by its investigations and examinations to the | 0012| appropriate district attorney and any other appropriate law | 0013| enforcement, administrative, regulatory or licensing agency and | 0014| assemble evidence, prepare charges and otherwise assist any | 0015| prosecutorial authority having jurisdiction over insurance | 0016| fraud enforcement; | 0017| F. assist any official or agency of this state, any | 0018| other state or the federal government that requests assistance | 0019| in investigating insurance fraud; | 0020| G. maintain records and information in order to | 0021| produce an annual report of its activities as may be prescribed | 0022| by the superintendent; and | 0023| H. conduct, in cooperation with the attorney | 0024| general and the department of public safety, public outreach | 0025| and awareness programs on the costs of insurance fraud to the | 0001| public and how members of the public can assist themselves, the | 0002| bureau and law enforcement officials in preventing and | 0003| prosecuting insurance fraud." | 0004| Section 6. A new section of the New Mexico Insurance Code | 0005| is enacted to read: | 0006| "[NEW MATERIAL] NOTICE AND COOPERATION REQUIRED-- | 0007| TOLLING PERIOD.-- | 0008| A. Every insurer or licensed insurance professional | 0009| that has a reasonable belief that an act of insurance fraud | 0010| will be, is being or has been committed shall furnish and | 0011| disclose knowledge and information about it to the bureau and | 0012| shall cooperate fully with any investigation conducted by the | 0013| bureau. Failure to comply with this subsection shall | 0014| constitute grounds for the superintendent to impose an | 0015| administrative penalty pursuant to Section 59A-1-18 NMSA 1978 | 0016| in addition to any applicable suspension, revocation or denial | 0017| of a license or certificate of authority. | 0018| B. Any person that has a reasonable belief that an | 0019| act of insurance fraud will be, is being or has been committed, | 0020| or any person that collects, reviews or analyzes information | 0021| concerning insurance fraud, may furnish and disclose any | 0022| information in its possession concerning the insurance fraud to | 0023| the bureau or to an authorized representative of an insurer | 0024| that requests the information for the purpose of detecting, | 0025| prosecuting or preventing insurance fraud. | 0001| C. If an insurer has a reasonable belief or | 0002| probable cause to believe that an insurance fraud has been | 0003| committed, and has properly notified the bureau of its | 0004| suspicion, that notification shall toll any applicable time | 0005| period in any unfair claims proceeding based on the alleged | 0006| fraud until thirty days after determination by the bureau and | 0007| notice to the insurer that the bureau will not recommend action | 0008| on the claim. | 0009| D. The bureau, in cooperation with insurers or | 0010| others, may establish a voluntary fund to reward persons not | 0011| connected with the insurance industry that provide information | 0012| or furnish evidence leading to the arrest and conviction of | 0013| persons responsible for insurance fraud." | 0014| Section 7. A new section of the New Mexico Insurance Code | 0015| is enacted to read: | 0016| "[NEW MATERIAL] IMMUNITY FROM CIVIL LIABILITY--PRIVATE | 0017| INSURANCE FRAUD REPORTS AND ENFORCEMENT ACTIONS.-- | 0018| A. The provisions of Section 59A-4-21 NMSA 1978 | 0019| regarding immunity from civil liability for enforcement actions | 0020| performed in good faith by the superintendent, his authorized | 0021| representatives and examiners shall apply to the Insurance | 0022| Fraud Act. | 0023| B. A person acting without malice, fraudulent | 0024| intent or bad faith shall not be subject to liability by virtue | 0025| of reporting or furnishing, orally or in writing, information | 0001| concerning suspected, anticipated or completed insurance fraud | 0002| acts when the report or information is provided to: | 0003| (1) the insurance department, the bureau or | 0004| law enforcement agencies, their officials, agents or employees; | 0005| or | 0006| (2) the national association of insurance | 0007| commissioners, a federal or state governmental agency or office | 0008| established to detect and prevent insurance fraud or any other | 0009| organization established for the same purpose, and their | 0010| agents, employees or designees. | 0011| C. A person identified in Subsection B of this | 0012| section or any of the person's officers, employees or agents | 0013| when performing their authorized activities, including the | 0014| publication or dissemination of any related bulletin or | 0015| reports, without malice, fraudulent intent or bad faith shall | 0016| not be subject to civil liability for libel, slander or any | 0017| other relevant tort, and no civil cause of action of any nature | 0018| shall exist against such persons. | 0019| D. This section shall not abrogate or modify in any | 0020| way any privilege or immunity recognized by common law or | 0021| statute. | 0022| E. The court shall award attorney fees and costs to | 0023| any person identified in Subsection B of this section or any of | 0024| that person's officers, employees or agents that is a | 0025| prevailing party in a civil cause of action against them for | 0001| libel, slander or any other relevant tort arising out of | 0002| conduct pursuant to the Insurance Fraud Act, provided the party | 0003| bringing the action was not substantially justified in bringing | 0004| such action. For the purposes of this subsection, | 0005| "substantially justified" means having a reasonable basis in | 0006| law or fact at the time a proceeding was initiated. | 0007| F. The relief provided in this section is in | 0008| addition to remedies otherwise available against the same | 0009| conduct under the common law or other laws of this state." | 0010| Section 8. A new section of the New Mexico Insurance Code | 0011| is enacted to read: | 0012| "[NEW MATERIAL] WARNING REQUIRED.--Within six months of | 0013| the effective date of the Insurance Fraud Act, all claims forms | 0014| and applications for insurance shall contain a statement, | 0015| permanently affixed to the application or claim form, which | 0016| states substantially as follows: | 0017| "ANY PERSON WHO KNOWINGLY PRESENTS A FALSE OR FRAUDULENT | 0018| CLAIM FOR PAYMENT OF A LOSS OR BENEFIT OR KNOWINGLY PRESENTS | 0019| FALSE INFORMATION IN AN APPLICATION FOR INSURANCE IS GUILTY OF | 0020| A CRIME AND MAY BE SUBJECT TO CIVIL FINES AND CRIMINAL | 0021| PENALTIES." | 0022| The failure to include that statement shall not constitute a | 0023| defense against prosecution for commission of insurance fraud." | 0024| Section 9. A new section of the New Mexico Insurance Code | 0025| is enacted to read: | 0001| "[NEW MATERIAL] REPORT OF CONVICTION.--If any person | 0002| licensed by any agency of any state or the federal government, | 0003| or holding credentials from any professional organization, is | 0004| convicted of insurance fraud in this state, the bureau shall | 0005| notify the appropriate licensing or credentialing authority of | 0006| the judgment for appropriate disciplinary action." | 0007| Section 10. A new section of the New Mexico Insurance | 0008| Code is enacted to read: | 0009| "[NEW MATERIAL] INSURER ANTI-FRAUD INITIATIVES--SPECIAL | 0010| INVESTIGATIVE UNITS.-- | 0011| A. Within six months of the effective date of the | 0012| Insurance Fraud Act, and by July 1 of each succeeding year, | 0013| every insurer who in the previous calendar year reported ten | 0014| million dollars ($10,000,000) or more in direct written | 0015| premiums in New Mexico shall establish, prepare, implement and | 0016| submit to the superintendent an anti-fraud plan that is | 0017| reasonably calculated to detect, prosecute and prevent | 0018| insurance fraud. Any subsequent amendments to the plan shall | 0019| be submitted to the superintendent at the time they are | 0020| adopted. | 0021| B. Each insurer's anti-fraud plan shall outline, at | 0022| a minimum, specific procedures, appropriate to the type of | 0023| insurance the insurer writes in this state, to: | 0024| (1) prevent, detect and investigate all forms | 0025| of insurance fraud; | 0001| (2) educate appropriate employees on fraud | 0002| detection and the insurer's anti-fraud plan; | 0003| (3) provide for the hiring or contracting of | 0004| fraud investigators; | 0005| (4) report insurance fraud to appropriate law | 0006| enforcement and regulatory authorities; and | 0007| (5) pursue restitution for financial loss | 0008| caused by insurance fraud, where appropriate. | 0009| C. The superintendent may review each insurer's | 0010| anti-fraud plan to determine if it adequately complies with the | 0011| requirements of this section. The superintendent may examine | 0012| the insurer to assure its compliance with anti-fraud plans | 0013| submitted to the superintendent. The superintendent may | 0014| require reasonable modifications to the insurer's anti-fraud | 0015| plan, or may require other reasonable remedial action if the | 0016| review or examination reveals substantial noncompliance with | 0017| the plan. | 0018| D. The superintendent may require each insurer to | 0019| file a summary of the insurer's anti-fraud activities and | 0020| results. Anti-fraud plans and summaries submitted to the | 0021| superintendent shall be privileged and confidential, shall not | 0022| be a public record and shall not be subject to discovery or | 0023| subpoena in any civil or criminal action; provided, however, | 0024| that the superintendent or the bureau may make summaries of | 0025| aggregate data available to the public. | 0001| E. This section confers no private right of | 0002| action." | 0003| Section 11. A new section of the New Mexico Insurance | 0004| Code is enacted to read: | 0005| "[NEW MATERIAL] INSURANCE FRAUD BUREAU--INVESTIGATORS.- | 0006| -The bureau's investigators shall be peace officers pursuant to | 0007| the provisions of Chapter 29, Article 1 NMSA 1978." | 0008| Section 12. A new section of the New Mexico Insurance | 0009| Code is enacted to read: | 0010| "[NEW MATERIAL] ATTORNEY GENERAL DUTIES.--When so | 0011| requested by the superintendent, the attorney general shall | 0012| assign one or more full-time assistant attorneys general to | 0013| assist the bureau in carrying out its duties, including | 0014| providing legal advice and prosecuting offenders. The actual | 0015| costs associated with the assignment of assistant attorneys | 0016| general to the bureau shall be paid out of the fund." | 0017| Section 13. A new section of the New Mexico Insurance | 0018| Code is enacted to read: | 0019| "[NEW MATERIAL] INSURANCE FRAUD POLICY ADVISORY GROUP.- | 0020| -The superintendent may create an insurance fraud policy | 0021| advisory group consisting of representatives of authorized | 0022| insurers in this state, consumers of insurance products not | 0023| otherwise connected with the insurance industry and other | 0024| appropriate persons. The superintendent shall appoint the | 0025| members and shall provide by regulation for the creation, | 0001| membership, governance, duties and termination of any member. | 0002| Any advisory group so created shall advise the superintendent | 0003| with respect to the implementation of and other matters related | 0004| to the Insurance Fraud Act when so requested by the | 0005| superintendent." | 0006| Section 14. A new section of the New Mexico Insurance | 0007| Code is enacted to read: | 0008| "[NEW MATERIAL] INSURANCE FRAUD FUND CREATED-- | 0009| APPROPRIATION.-- | 0010| A. There is hereby created an "insurance fraud | 0011| fund" in the state treasury. All fees collected under the | 0012| provisions of the Insurance Fraud Act shall be deposited in the | 0013| fund and are appropriated to the superintendent for use in | 0014| paying the expenses of the bureau and the personnel costs of | 0015| the attorney general and other agencies providing services to | 0016| the bureau. Interest on the fund shall be credited to the | 0017| fund. The fund is a continuing, non-reverting fund. | 0018| B. To implement the provisions of the Insurance | 0019| Fraud Act, upon the effective date of the Insurance Fraud Act, | 0020| and in May of each subsequent year, the superintendent shall | 0021| assess each authorized insurer an annual fee in accordance with | 0022| the following schedule or such other similar schedule as the | 0023| superintendent may adopt in order to adequately fund the | 0024| operations of the bureau: | 0025| (1) two hundred dollars ($200) for an insurer | 0001| with reported gross direct written premiums in New Mexico in | 0002| the preceding calendar year of one million dollars ($1,000,000) | 0003| or less; | 0004| (2) four hundred dollars ($400) for an insurer | 0005| with reported gross direct written premiums in New Mexico in | 0006| the preceding calendar year of two million five hundred | 0007| thousand dollars ($2,500,000) or less but more than one million | 0008| dollars ($1,000,000); | 0009| (3) seven hundred dollars ($700) for an | 0010| insurer with reported gross direct written premiums in New | 0011| Mexico in the preceding calendar year of five million dollars | 0012| ($5,000,000) or less but more than two million five hundred | 0013| thousand dollars ($2,500,000); | 0014| (4) one thousand five hundred dollars ($1,500) | 0015| for an insurer with reported gross direct written premiums in | 0016| New Mexico in the preceding calendar year of ten million | 0017| dollars ($10,000,000) or less but more than five million | 0018| dollars ($5,000,000); | 0019| (5) four thousand dollars ($4,000) for an | 0020| insurer with reported gross direct written premiums in New | 0021| Mexico in the preceding calendar year of fifty million dollars | 0022| ($50,000,000) or less but more than ten million dollars | 0023| ($10,000,000); and | 0024| (6) seven thousand dollars ($7,000) for an | 0025| insurer with reported gross direct written premiums in New | 0001| Mexico in the preceding calendar year of more than fifty | 0002| million dollars ($50,000,000). | 0003| C. In no event shall the aggregate annual | 0004| assessment exceed one-half of one percent of the preceding | 0005| annual aggregate gross direct written premiums in New Mexico of | 0006| all authorized insurers. | 0007| D. The fees required by this section are in | 0008| addition to all other taxes and fees now imposed or that may be | 0009| subsequently imposed." | 0010| Section 16. A new section of the New Mexico Insurance | 0011| Code is enacted to read: | 0012| "[NEW MATERIAL] APPLICATION OF ACT TO OTHER ACTS.-- | 0013| A. No authority granted the superintendent under | 0014| the Insurance Fraud Act shall be construed to abrogate or | 0015| interfere with the authority of the safety and fraud division | 0016| of the workers' compensation administration under the Workers' | 0017| Compensation Act or of the medicaid fraud unit under the | 0018| Medicaid Fraud Act. | 0019| B. Nothing in the Insurance Fraud Act shall: | 0020| (1) preempt the authority of or relieve the | 0021| duty of any other law enforcement agencies to investigate and | 0022| prosecute alleged violations of law; | 0023| (2) prevent or prohibit a person from | 0024| voluntarily disclosing any information concerning insurance | 0025| fraud to any law enforcement agency other than the bureau; | 0001| (3) limit any of the powers granted elsewhere | 0002| by the laws of this state to the superintendent to investigate | 0003| alleged violations of law and take appropriate action; or | 0004| (4) interfere with the duties and authority of | 0005| the workers' compensation administration." | 0006| Section 17. A new section of the New Mexico Insurance | 0007| Code is enacted to read: | 0008| "[NEW MATERIAL] REGULATIONS.--The superintendent may | 0009| promulgate regulations deemed necessary or appropriate by the | 0010| superintendent for the administration of the Insurance Fraud | 0011| Act." | 0012| Section 18. APPROPRIATION.-- | 0013| A. Five hundred sixty thousand dollars ($560,000) | 0014| is appropriated from the insurance fraud fund to the | 0015| superintendent of insurance for expenditure in fiscal year 1998 | 0016| for the purpose of carrying out the provisions of the Insurance | 0017| Fraud Act. Any unexpended or unencumbered balance remaining at | 0018| the end of fiscal year 1998 shall not revert to the general | 0019| fund. | 0020| B. The superintendent of insurance is authorized to | 0021| employ five additional full-time permanent employees to carry | 0022| out the purposes of the Insurance Fraud Act; the attorney | 0023| general is authorized to employ one additional full-time | 0024| permanent assistant attorney general to carry out the purposes | 0025| of the Insurance Fraud Act. | 0001| Section 19.
