LARRANAGA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO GAMING; ENACTING THE SENIOR CITIZEN BINGO ACT; | 0012| AUTHORIZING SENIOR CITIZEN GROUPS TO CONDUCT BINGO GAMES; | 0013| PROVIDING CIVIL PENALTIES; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SHORT TITLE.--This act may be cited as the | 0017| "Senior Citizen Bingo Act". | 0018| Section 2. PURPOSE OF ACT.--The purpose of the Senior | 0019| Citizen Bingo Act is to make lawful the conduct of bingo games | 0020| by senior citizen groups and to enhance the social interaction | 0021| enjoyed by senior citizen groups that engage in bingo games. | 0022| Section 3. DEFINITIONS.--As used in the Senior Citizen | 0023| Bingo Act: | 0024| A. "bingo" means a game in which prizes are awarded | 0025| on the basis of designated numbers or symbols on a card | 0001| conforming to numbers or symbols selected at random and for | 0002| which no cards are sold except at the time and place of the | 0003| game; | 0004| B. "occasion" means a single gathering or session | 0005| in which a series of one or more bingo games are played; and | 0006| C. "senior citizen group" means an organization, | 0007| including nursing facilities; homes for the aged or disabled; | 0008| private residences that provide personal care, sheltered care | 0009| or nursing care for one or more persons; adult daycare centers; | 0010| boarding homes; or adult residential shelter care homes, the | 0011| majority of the membership or participants of which consists of | 0012| individuals fifty-five years of age or older and that provides | 0013| recreational or social activities, or both, for those | 0014| individuals. | 0015| Section 4. SENIOR CITIZEN BINGO--PERMITTED--LICENSE NOT | 0016| REQUIRED--PENALTIES--ENFORCEMENT.-- | 0017| A. Nothing in Chapter 30, Article 19 NMSA 1978 | 0018| shall be interpreted to prevent senior citizen groups from | 0019| participating in bingo; provided, however, that: | 0020| (1) no person other than a player | 0021| participating in the bingo receives or becomes entitled to | 0022| receive a part of the proceeds from the bingo; | 0023| (2) no minor is permitted to participate in | 0024| the conduct of or play in the bingo; | 0025| (3) the staff or patrons of the senior citizen | 0001| group shall conduct and oversee the bingo; and | 0002| (4) the aggregate amount of all prizes offered | 0003| or given in all bingo played on a single occasion by a senior | 0004| citizen group shall not exceed one hundred dollars ($100). | 0005| B. No senior citizen group shall be required to | 0006| have a license to conduct bingo. | 0007| Section 5. CIVIL PENALTIES.-- | 0008| A. If the state agency on aging reasonably believes | 0009| that a senior citizen group has violated or is violating any | 0010| provision of the Senior Citizen Bingo Act, the state agency on | 0011| aging may refer the matter to the attorney general or a | 0012| district attorney for enforcement. | 0013| B. The attorney general or district attorney may | 0014| institute a civil action in district court for any violation of | 0015| the Senior Citizen Bingo Act or to prevent a violation of that | 0016| act. An action for relief may include a permanent or temporary | 0017| injunction, a restraining order or any other appropriate order, | 0018| including a civil penalty of fifty dollars ($50.00) for each | 0019| violation. | 0020| Section 6.
