    |
0011|     RELATING TO CONSERVANCY DISTRICTS; PROVIDING CERTAIN
    |
0012|     CONSERVANCY DISTRICTS WITH POWER TO COMMISSION PEACE OFFICERS;
    |
0013|     AMENDING AND ENACTING SECTIONS OF THE NMSA 1978; DECLARING AN
    |
0014|     EMERGENCY.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 73-14-18 NMSA 1978 (being Laws 1975,
    |
0018|     Chapter 262, Section 1) is amended to read:
    |
0019|          "73-14-18.  ABOLITION OF BOARDS OF DIRECTORS OF DISTRICTS
    |
0020|     HAVING MORE THAN ONE HUNDRED THOUSAND ACRES AND CREATED PRIOR
    |
0021|     TO 1930.--As [the same are] now constituted, any conservancy
    |
0022|     district organized under the provisions of the Conservancy Act
    |
0023|     of New Mexico and such conservancy district being created prior
    |
0024|     to 1930 and embracing land situate in four or more counties
    |
0025|     and having an appointed board of directors shall, after the
    |
0001|     election and qualification of the board of directors, cease to
    |
0002|     have an appointed board of directors and in lieu thereof shall
    |
0003|     have an elected board of directors as provided in Sections
    |
0004|     [75-28-11.1 through 75-28-11.15 NMSA 1953] 73-14-18 through
    |
0005|     73-14-32 NMSA 1978, which board of directors shall bear the
    |
0006|     name "board of directors of the ______________________
    |
0007|     conservancy district" and shall be a body corporate, may sue
    |
0008|     and be sued, shall have the power to commission peace
    |
0009|     officers and which shall succeed to, have, exercise, enjoy,
    |
0010|     assume and perform all of the rights, powers, obligations and
    |
0011|     duties now by law vested in, conferred upon, imposed upon or
    |
0012|     required of the boards [hereby] abolished by this section."
    |
0013|          Section 2.  Section 73-14-52 NMSA 1978 (being Laws 1951,
    |
0014|     Chapter 222, Section 4) is amended to read:
    |
0015|          "73-14-52.  ENFORCEMENT.--Conservancy districts, having
    |
0016|     adopted ordinances, rules and regulations providing for the
    |
0017|     protection of the bosque, district property and the citizens of
    |
0018|     New Mexico and for the distribution and allocation of
    |
0019|     irrigation waters pursuant to the provisions of [this act]
    |
0020|     Sections 73-14-49 through 73-14-53 NMSA 1978, shall have all
    |
0021|     powers available by law to enforce [the same] the rules,
    |
0022|     regulations and ordinances, including the right of injunction
    |
0023|     and mandamus. A conservancy district with an elected board of
    |
0024|     directors that is organized pursuant to the Conservancy Act of
    |
0025|     New Mexico, was created prior to 1930, embraces land situate in
    |
0001|     four or more counties and includes more than one hundred
    |
0002|     thousand acres of land may commission peace officers as deemed
    |
0003|     necessary by the board of directors to enforce the rules,
    |
0004|     regulations and criminal ordinances of that district or the
    |
0005|     laws or ordinances of the state, county or municipality that
    |
0006|     has jurisdiction over the site at which a crime has been
    |
0007|     committed."
    |
0008|          Section 3.  [NEW MATERIAL]  ENFORCEMENT--CONSERVANCY
    |
0009|     DISTRICT PEACE OFFICERS.--
    |
0010|               A.  The peace officer of a conservancy district that
    |
0011|     has the power to commission peace officers is authorized to
    |
0012|     perform all acts necessary to enforce the criminal ordinances,
    |
0013|     rules and regulations of that conservancy district including:
    |
0014|                    (1)  suppressing all riots, disturbances and
    |
0015|     breaches of the peace;
    |
0016|                    (2)  apprehending all disorderly persons;
    |
0017|                    (3)  providing aid requested by any other law
    |
0018|     enforcement agency;
    |
0019|                    (4)  issuing citations, apprehending or
    |
0020|     arresting any person within the jurisdiction of the conservancy
    |
0021|     district who is in the act of violating the law of the state or
    |
0022|     the ordinances of the county, municipality or the conservancy
    |
0023|     district and bring him before competent authority for detention
    |
0024|     or trial; and
    |
0025|          `         (5)  fulfilling the duties of a peace officer
    |
0001|     pursuant to the provisions of Chapter 29, Article 1 NMSA 1978.
    |
0002|               B.  In the discharge of his proper duties, a peace
    |
0003|     officer of a conservancy district shall have the same powers
    |
0004|     and be subject to the same responsibilities as sheriffs in
    |
0005|     similar cases.
    |
0006|          Section 4.  EMERGENCY.--It is necessary for the public
    |
0007|     peace, health and safety that this act take effect immediately.
