FORTY-THIRD LEGISLATURE HB 1056/a FIRST SESSION, 1997 March 14, 1997 Mr. President: Your FINANCE COMMITTEE, to whom has been referred HOUSE BILL 1056, as amended has had it under consideration and reports same with recommendation that it DO PASS, amended as follows: 1. On page 2, line 12, strike the closing quotation mark and between lines 12 and 13, insert the following new subsection: "C. State legislator member coverage plan 1 is also applicable to a state legislator who: (1) was unable to become a member or unable to make member contributions during the period from December 29, 1988 through July 15, 1996 because administration of state legislator member coverage plan 1 was suspended due to litigation; and (2) because of the death of the legislator after the November 22, 1995 New Mexico supreme court decision in Udall v. P.E.R.B. et al. 120 N.M. 786 (1995) but prior to June 15, 1996, was unable to comply with the public employees retirement association June 15, 1996 rule establishing procedures for acquiring benefits. The eligible surviving spouse of the legislator, as defined by Section 10-11-14.5 NMSA 1978, may on behalf of the legislator enroll in the plan by making application and paying member contributions as the association may prescribe."".
