BEAM | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO WILDLIFE CONSERVATION; AMENDING A SECTION OF THE | 0012| NMSA 1978; DECLARING AN EMERGENCY. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. Section 17-2-41 NMSA 1978 (being Laws 1974, | 0016| Chapter 83, Section 5, as amended) is amended to read: | 0017| "17-2-41. ENDANGERED SPECIES.-- | 0018| A. On the basis of investigations concerning | 0019| wildlife, other available scientific and commercial data and | 0020| after consultation with wildlife agencies in other states, | 0021| appropriate federal agencies, local and tribal governments and | 0022| other interested persons and organizations, the commission | 0023| shall by regulation develop a list of those species of wildlife | 0024| indigenous to the state that are determined to be threatened or | 0025| endangered within the state, giving their common and scientific | 0001| names by species and subspecies. | 0002| B. The director shall conduct a review of the state | 0003| list of threatened or endangered species and shall present | 0004| biennially to the commission his recommendations for | 0005| appropriate action. The commission shall act on the director's | 0006| biennial recommendations at its next regularly scheduled | 0007| meeting. The commission shall adopt, no later than January 1, | 0008| 1996, regulations providing procedures for commission actions | 0009| on the director's recommendations to continue to list or to | 0010| upgrade or downgrade a species. | 0011| C. Except as otherwise provided in the Wildlife | 0012| Conservation Act, it is unlawful for any person to take, | 0013| possess, transport, export, process, sell or offer for sale or | 0014| ship any species of wildlife appearing on any of the following | 0015| lists: | 0016| (1) the list of wildlife indigenous to the | 0017| state determined to be threatened or endangered within the | 0018| state as set forth by regulations of the commission; provided | 0019| that limited take, possession or transport of threatened | 0020| species may be authorized by regulation of the commission if | 0021| the take, possession or transport is addressed in a recovery or | 0022| conservation plan approved by the commission; and | 0023| (2) the United States lists of endangered | 0024| native and foreign fish and wildlife as set forth in Section 4 | 0025| of the Endangered Species Act of 1973 as endangered or | 0001| threatened species, but only to the extent that those lists are | 0002| adopted for this purpose by regulations of the commission; | 0003| provided that limited take, possession or transport of | 0004| threatened species may be authorized by regulation of the | 0005| commission if the take, possession or transport is addressed in | 0006| a recovery or conservation plan approved by the commission; | 0007| and provided further that any species of wildlife appearing | 0008| on any of the lists set forth in this subsection, transported | 0009| into the state from another state or from a point outside the | 0010| territorial limits of the United States and [which] that is | 0011| destined for a point beyond the state, may be transported | 0012| across the state without restriction in accordance with the | 0013| terms of any federal permit or permit issued under the laws or | 0014| regulations of another state or otherwise in accordance with | 0015| the laws of another state. | 0016| D. The provisions of Subsection C of this section | 0017| shall not apply to a taking of wildlife by a Native American | 0018| for religious purposes, unless it materially and negatively | 0019| affects an endangered species or threatened species." | 0020| Section 2.
