0011|     RELATING TO HIGHWAYS; AUTHORIZING THE STATE HIGHWAY AND
    |
0012|     TRANSPORTATION DEPARTMENT TO REMOVE CERTAIN OBSTRUCTIONS FROM
    |
0013|     STATE HIGHWAY ROADWAYS AND RIGHTS OF WAY.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  REMOVAL OF OBSTRUCTIONS FROM ROADWAY OR RIGHT
    |
0017|     OF WAY.--
    |
0018|               A.  The state highway and transportation department
    |
0019|     may, without the consent of the owner or carrier of spilled
    |
0020|     cargo or other personal property on the right of way or any
    |
0021|     portion of roadway of the state highway system, remove the
    |
0022|     cargo or property from the right of way or portion of roadway
    |
0023|     of the state highway system in circumstances in which, as
    |
0024|     determined by the department, the cargo or property is blocking
    |
0025|     the roadway or may otherwise be endangering public safety.  
    |
0001|               B.  The state highway and transportation department
    |
0002|     is hereby authorized to render minimum assistance at no charge
    |
0003|     to motorists who are stranded on a right of way or roadway of
    |
0004|     the state highway system.  Such assistance may include pushing
    |
0005|     vehicles off the roadway, providing minimal mechanical
    |
0006|     assistance or emergency gasoline to stranded motorists and
    |
0007|     providing assistance in tire changing when it is in the
    |
0008|     interest of public safety to do so.
    |
0009|               C.  The state highway and transportation department
    |
0010|     may, pursuant to Subsection A of this section, remove cargo or
    |
0011|     personal property that the department has reason to believe is
    |
0012|     hazardous material as defined by the federal Hazardous
    |
0013|     Materials Transportation Authorization Act of 1994, or a
    |
0014|     hazardous substance as defined by the Emergency Management Act;
    |
0015|     provided that in doing so, the department must comply with
    |
0016|     applicable provisions of the Emergency Management Act.
    |
0017|               D.  The state highway and transportation department
    |
0018|     and its officers and employees are not liable for any damages
    |
0019|     or claims of damages to removed cargo or personal property that
    |
0020|     resulted from removal or disposal by the department unless the
    |
0021|     removal or disposal was carried out recklessly or involves
    |
0022|     wanton or intentional misconduct.
    |
0023|               E.  The state highway and transportation department
    |
0024|     and its officers and employees are not liable for any damages
    |
0025|     or claims that may result from the failure to exercise any
    |
0001|     authority granted under this section.
    |
0002|               F.  The owner or carrier of cargo or personal
    |
0003|     property removed under the authority of Subsection A or C of
    |
0004|     this section shall reimburse the state highway and
    |
0005|     transportation department for the costs of the removal and
    |
0006|     disposition.

0007|        "Section 2.  Section 41-4-11 NMSA 1978 (being Laws 1976,

0008|   Chapter 58, Section 11, as amended) is amended to read:

0010|        "41-4-11.  LIABILITY--HIGHWAYS AND STREETS.--
    |
0011|   
    |
0012|             A.  The immunity granted pursuant to Subsection A of
    |
0013|   Section 41-4-4 NMSA 1978 does not apply to liability for damages
    |
0014|   resulting from bodily injury, wrongful death or property damage
    |
0015|   caused by the negligence of public employees while acting within
    |
0016|   the scope of their duties during the construction, and in
    |
0017|   subsequent maintenance, of any bridge, culvert, highway, roadway,
    |
0018|   street, alley, sidewalk or parking area.
    |
0019|   
    |
0020|             B.  The liability for which immunity has been waived
    |
0021|   pursuant to Subsection A of this section shall not include
    |
0022|   liability for damages caused by:
    |
0023|   
    |
0024|                  (1)  a defect in plan or design of any bridge,
    |
0025|   culvert, highway, roadway, street, alley, sidewalk or parking
    |
0001|   area; 
    |
0002|   
    |
0003|                  (2)  the failure to construct or reconstruct any
    |
0004|   bridge, culvert, highway, roadway, street, alley, sidewalk or
    |
0005|   parking area; [or]
    |
0006|   
    |
0007|                  (3)  a deviation from standard geometric design
    |
0008|   practices for any bridge, culvert, highway, roadway, street,
    |
0009|   alley, sidewalk or parking area allowed on a case-by-case basis
    |
0010|   for appropriate cultural, ecological, economic, environmental,
    |
0011|   right of way through Indian lands, historical or technical
    |
0012|   reasons, provided the deviation:
    |
0013|   
    |
0014|                       (a)  is required by extraordinary
    |
0015|   circumstances;
    |
0016|   
    |
0017|   
    |
0018|                       (b)  has been approved by the governing
    |
0019|   authority; and
    |
0020|   
    |
0021|                       (c)  is reasonable and necessary as
    |
0022|   determined by the application of sound engineering principles
    |
0023|   taking into consideration the appropriate cultural, ecological,
    |
0024|   economic, environmental, right of way through Indian lands,
    |
0025|   historical or technical circumstances; or
    |
0001|   
    |
0002|                  (4)  the failure to remove any spilled cargo or
    |
0003|   other personal property from the right of way or any portion of
    |
0004|   roadway of the state highway system or the failure to render
    |
0005|   assistance to motorists who are stranded on a right of way or
    |
0006|   roadway of the state highway system."".
