0011|     RELATING TO SOVEREIGN IMMUNITY; ALLOWING THE DIRECTOR OF THE

0012|     RISK MANAGEMENT DIVISION OF THE GENERAL SERVICES DEPARTMENT TO

0013|     WAIVE THE STATE'S IMMUNITY UNDER THE ELEVENTH AMENDMENT TO THE

0014|     CONSTITUTION OF THE UNITED STATES.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0017|          Section 1.  SOVEREIGN IMMUNITY--WAIVER BY DIRECTOR.--The
    |
0018|     director of the risk management division of the general
    |
0019|     services department, at his sole discretion on a case-by-case
    |
0020|     basis, may waive the state's immunity under the eleventh
    |
0021|     amendment to the constitution of the United States by filing a
    |
0022|     written waiver in federal court.  This waiver shall not apply
    |
0023|     to any action involving Indian gambling.
