0011| RELATING TO PUBLIC SCHOOLS; ENACTING A NEW SECTION OF THE

0012| PUBLIC SCHOOL CODE; PROVIDING MANDATORY DISCIPLINARY PROCEDURES

0013| FOR A STUDENT WHO ASSAULTS A TEACHER OR MEMBER OF THE

0014| EDUCATIONAL STAFF.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0017| Section 1. DISCIPLINE FOR ASSAULT.--In addition to other
|
0018| student policies or remedies at law, a student who commits an
|
0019| assault upon a teacher or staff member of the school in which
|
0020| the student is attending shall be disciplined as follows:
|
0021| A. mandatory suspension for at least three school
|
0022| days if the assault is verbal;
|
0023| B. mandatory suspension for at least six school
|
0024| days if the assault is physical;
|
0025| C. mandatory expulsion from school if the there is
|
0001| substantive physical harm inflicted upon the teacher or staff
|
0002| member as the result of the assault; or
|
0003| D. mandatory expulsion from school for a second or
|
0004| subsequent assault offense.
