0011| RELATING TO PAROLE; PROVIDING SPECIFIC TIMELINES FOR THE

0012| JUVENILE PAROLE BOARD TO REVIEW A CHILD'S ELIGIBILITY FOR
|
0013| PAROLE; AMENDING SECTIONS OF THE JUVENILE PAROLE BOARD ACT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 32A-7-2 NMSA 1978 (being Laws 1993,
|
0017| Chapter 77, Section 195) is amended to read:
|
0018| "32A-7-2. JUVENILE PAROLE BOARD--TERMS--DIRECTOR.--
|
0019| A. The "juvenile parole board" is created,
|
0020| consisting of [three] five members appointed by the
|
0021| governor. The juvenile parole board is administratively
|
0022| attached to the department. The terms of members of the board
|
0023| shall be six years.
|
0024| B. A director will be appointed by the governor as
|
0025| the administrative officer of the juvenile parole board. The
|
0001| director shall employ other staff as is necessary to carry out
|
0002| the duties of the board. Employees shall be employed in
|
0003| classified positions and shall be subject to the provisions of
|
0004| the Personnel Act."
|
0005| Section 2. Section 32A-7-8 NMSA 1978 (being Laws 1993,
|
0006| Chapter 77, Section 201) is amended to read:
|
0007| "32A-7-8. PAROLE ELIGIBILITY.--
|
0008| A. A child [is eligible to] shall appear before
|
0009| the juvenile parole board no later than forty days after the
|
0010| entry of a judgment transferring legal custody to an agency for
|
0011| the care and rehabilitation of delinquent children, unless
|
0012| recommended for an earlier appearance by the agency responsible
|
0013| for such care and rehabilitation.
|
0014| B. In the event parole is denied, the child shall
|
0015| [be eligible] appear before the juvenile parole board for
|
0016| review every sixty days thereafter if the child received a
|
0017| short-term commitment of one year, or every ninety days
|
0018| thereafter, if the child received a long-term commitment for no
|
0019| more than two years.
|
0020| C. The juvenile parole board may review the case of
|
0021| any child upon its own motion at any time after parole is
|
0022| denied.
|
0023| D. The provisions of the Juvenile Parole Board Act
|
0024| apply to all children who, on [the effective date of that
|
act] July 1, 1997, are on parole or eligible to be placed on
|
0001| parole with the same effect as if that act had been in effect
|
0002| at the time they were placed on parole or became eligible to be
|
0003| placed on parole."

0013| his twenty-first birthday or shall participate in an early
|
0014| release program approved by the department.".,
