    |
0020|     RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE;
    |
0021|     PROVIDING FOR AGRICULTURAL EMERGENCY PEST CONTROL MEASURES;
    |
0022|     AUTHORIZING AN INVOLUNTARY ERADICATION FEE ASSESSMENT; CREATING
    |
0023|     A FUND; MAKING AN APPROPRIATION.

    |
0025|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0001|          Section 1.  A new section of the Pest Control Act is
    |
0002|     enacted to read:
    |
0003|          "[NEW MATERIAL]  EMERGENCY MEASURES--FEE ASSESSMENT.--
    |
0004|               A.  When the board finds that a continuing threat of
    |
0005|     spread of a pest exists and, after appropriate notice, a
    |
0006|     property owner does not take immediate voluntary measures to
    |
0007|     prevent or retard the spread of the pest as allowed by Section
    |
0008|     76-6-4 NMSA 1978, the board may take reasonable emergency
    |
0009|     action as necessary in accordance with the provisions of the
    |
0010|     Pest Control Act.
    |
0011|               B.  The board may assess an involuntary eradication
    |
0012|     fee, not to exceed one thousand dollars ($1,000), against the
    |
0013|     owner of the property that was subject to the board's emergency
    |
0014|     action."
    |
0015|          Section 2.  A new section of the Pest Control Act is
    |
0016|     enacted to read:
    |
0017|          "[NEW MATERIAL]  FUND CREATED--ADMINISTRATION.--The
    |
0018|     "pest eradication fund" is created in the state treasury to
    |
0019|     consist of fees assessed pursuant to Section 1 of this act. 
    |
0020|     The fund shall be administered by the board, and money in the
    |
0021|     fund is appropriated to the board to defray the costs of taking
    |
0022|     emergency action to suppress, control, eradicate, prevent or
    |
0023|     retard the spread of a pest, as authorized in Section 1 of this
    |
0024|     act."

0013|     PROVIDING FOR COST RECOVERY FOR AGRICULTURAL EMERGENCY PEST
    |
0014|     CONTROL ACTIONS; AMENDING A SECTION OF THE NMSA 1978.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 76-6-6 NMSA 1978 (being Laws 1969,
    |
0018|     Chapter 41, Section 6) is amended to read:
    |
0019|          "76-6-6.  ABATEMENT AND EMERGENCY MEASURES AUTHORIZED.--
    |
0020|               A.  Whenever the board finds any article that is
    |
0021|     infested or reasonably believed to be infested or a host or
    |
0022|     pest exists on any [premise] premises or is in transit in
    |
0023|     this state, [he] it may, upon giving notice to the owner or
    |
0024|     his agent in possession thereof, seize, quarantine, treat or
    |
0025|     otherwise dispose of [such] the pest, host or article in
    |
0001|     such manner as the board deems necessary to suppress, control,
    |
0002|     eradicate or [to] prevent or retard the spread of a pest, or
    |
0003|     the board may order [such] the owner or agent to so treat
    |
0004|     or otherwise dispose of the pest, host or article.
    |
0005|               B.  When the board finds that a continuing threat
    |
0006|     of the spread of a pest exists, and after appropriate notice,
    |
0007|     an owner or his agent does not take immediate measures to
    |
0008|     prevent or retard the spread of the pest, the board may take
    |
0009|     reasonable emergency action as necessary in accordance with the
    |
0010|     provisions of the Pest Control Act and regulations of the
    |
0011|     board.  The board may assess an emergency action fee to recover
    |
0012|     the cost of the emergency action, not to exceed one thousand
    |
0013|     dollars ($1,000), against the owner of the property that was
    |
0014|     subject to the boards's emergency action."
