0025| RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE;

0001| MAKING APPROPRIATIONS FOR THE PURPOSE OF CARRYING OUT THE
|
0002| PROVISIONS OF THE FAMILY ASSISTANCE AND INDIVIDUAL
|
0003| RESPONSIBILITY ACT; PROVIDING FOR THE MAINTENANCE OF EFFORT
|
0004| REQUIRED TO OBTAIN THE FEDERAL TEMPORARY ASSISTANCE FOR NEEDY
|
0005| FAMILIES BLOCK GRANT.
|

0007| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0008| Section 1. APPROPRIATIONS.--
|
0009| A. Contingent upon the enactment into law of the
|
0010| Family Assistance and Individual Responsibility Act by the
|
0011| first session of the forty-third legislature:
|
0012| (1) one hundred twenty-eight million dollars
|
0013| ($128,000,000) is appropriated from federal funds pursuant to
|
0014| Section 901 of the federal Personal Responsibility and Work
|
0015| Opportunity Reconciliation Act of 1996, Public Law 104-193, to
|
0016| the human services department for expenditure in fiscal year
|
0017| 1998 for the purpose of carrying out the provisions of the
|
0018| Family Assistance and Individual Responsibility Act. Any
|
0019| unexpended or unencumbered balance remaining at the end of
|
0020| fiscal year 1998 shall not revert; and
|
0021| (2) thirty-five million dollars ($35,000,000)
|
0022| is appropriated from the general fund to the human services
|
0023| department for expenditure in fiscal year 1998 for the purpose
|
0024| of carrying out the provisions of the Family Assistance and
|
0025| Individual Responsibility Act. Any unexpended or unencumbered
|
0001| balance remaining at the end of fiscal year 1998 shall revert
|
0002| to the general fund.
|
0003| B. The appropriation in Paragraph (2) of Subsection
|
0004| A of this section, together with other appropriations to the
|
0005| human services department, the children, youth and families
|
0006| department and the labor department in the General
|
0007| Appropriation Act of 1997, shall be used to meet the one
|
0008| hundred percent of the maintenance of effort required to obtain
|
0009| both the federal temporary assistance for needy families block
|
0010| grant and its contingency pursuant to the federal Personal
|
0011| Responsibility and Work Opportunity Reconciliation Act of 1996,
|
0012| Public Law 104-193.
|
0013| C. The appropriations authorized in this section
|
0014| shall only take effect if the Family Assistance and Individual
|
0015| Responsibility Act is enacted into law by the first session of
|
0016| the forty-third legislature. State of New Mexico
