0011|     RELATING TO ALCOHOLIC BEVERAGES; MAKING IT A VIOLATION OF THE
    |
0012|     LIQUOR CONTROL ACT FOR A DISPENSER TO MAKE CERTAIN OFFERS OR
    |
0013|     SALES OF ALCOHOLIC BEVERAGES; PROVIDING PENALTIES; ENACTING A
    |
0014|     NEW SECTION OF THE LIQUOR CONTROL ACT.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  A new section of the Liquor Control Act is
    |
0018|     enacted to read:
    |
0019|          "[<u>NEW MATERIAL</u>]  OFFENSES BY DISPENSERS--PROHIBITED
    |
0020|     OFFERS OR SALES OF ALCOHOLIC BEVERAGES.--It is a violation of
    |
0021|     the Liquor Control Act for a dispenser to:
    |
0022|               A.  offer or deliver free alcoholic beverages to a
    |
0023|     person;
    |
0024|               B.  deliver more than two alcoholic beverages to one
    |
0025|     person at one time;
    |
0001|               C.  sell, offer to sell or deliver to a person an
    |
0002|     alcoholic beverage at a price less than the price regularly
    |
0003|     charged for the alcoholic beverage during the same calendar
    |
0004|     week;
    |
0005|               D.  sell, offer to sell or deliver to a person an
    |
0006|     unlimited number of alcoholic beverages during a set period of
    |
0007|     time for a fixed price;
    |
0008|               E.  sell, offer to sell or deliver beer or
    |
0009|     spirituous liquors by the pitcher, except to two or more
    |
0010|     persons at one time;
    |
0011|               F.  increase the volume of alcoholic beverages
    |
0012|     contained in a drink without increasing proportionately the
    |
0013|     price regularly charged for the drink during the same calendar
    |
0014|     week; or
    |
0015|               G.  encourage or permit a game or contest that
    |
0016|     involves drinking alcoholic beverages or the awarding of
    |
0017|     alcoholic beverages as prizes."  
    |
0018|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0019|     provisions of this act is July 1, 1997.
