Section 30-16-21 NMSA 1978 (being Laws 1977, | 0017| Chapter 104, Section 1) is amended to read: | 0018| "30-16-21. CIVIL LIABILITY OF [ADULT] SHOPLIFTER | 0019| PARENT OR GUARDIAN--DAMAGES--PENALTY.-- | 0020| A. Any [person who has reached the age of | 0021| majority and who has been convicted of shoplifting under | 0022| Section 40A-16-20 NMSA 1953] adult or emancipated minor who | 0023| commits an act of shoplifting, as defined in Section 30-16-20 | 0024| NMSA 1978, may be civilly liable for the retail value of the | 0025| merchandise, punitive damages of not less than [one hundred | 0001| dollars ($100) nor] two hundred dollars ($200) or more than | 0002| [two hundred fifty dollars ($250)] five hundred dollars | 0003| ($500), costs of the suit and reasonable [attorney's] | 0004| attorney fees. However, the merchant shall not be entitled | 0005| to recover damages for the retail value of any recovered | 0006| undamaged merchandise. | 0007| B. The court may order the parents or legal | 0008| guardian of an unemancipated minor who commits an act of | 0009| shoplifting, as defined in Section 30-16-20 NMSA 1978, to make | 0010| restitution up to the retail value of the merchandise, to pay | 0011| punitive damages of not less than two hundred dollars ($200) or | 0012| more than five hundred dollars ($500) and to pay reasonable | 0013| costs and attorney fees. | 0014| C. A conviction under Section 30-16-20 NMSA 1978 is | 0015| not a condition precedent for the maintenance of an action | 0016| under this section. | 0017| D. A merchant who has suffered a loss as a result | 0018| of a violation of Section 30-16-20 NMSA 1978 may demand, in | 0019| writing, restitution and damages from the parents or guardian | 0020| of an unemancipated minor, prior to the commencement of any | 0021| action under this section. | 0022| E.
