LYONS | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR CAPITAL PROJECTS IN SENATE DISTRICT 7; | 0013| MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0017| APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not to exceed the total of the amounts | 0021| authorized for the purposes specified in Sections 2 through 6 | 0022| of this act. The state board of finance shall schedule the | 0023| issuance and sale of the bonds in the most expeditious and | 0024| economical manner possible upon a finding by the board that the | 0025| project has been developed sufficiently to justify the issuance | 0001| and that the project can proceed to contract within a | 0002| reasonable time. The state board of finance shall further take | 0003| the appropriate steps necessary to comply with the Internal | 0004| Revenue Code of 1986, as amended. Proceeds from the sale of | 0005| the bonds are appropriated for the purposes specified in | 0006| Sections 2 through 6 of this act. | 0007| B. The agencies named in Sections 2 through 6 of | 0008| this act shall certify to the state board of finance when the | 0009| money from the proceeds of the severance tax bonds authorized | 0010| in this section is needed for the purposes specified in the | 0011| applicable section of this act. | 0012| C. If the specified agency has not certified the | 0013| need for the issuance of the bonds by the end of fiscal year | 0014| 1999, the authorization provided in this act shall be void. | 0015| D. Unless otherwise specified in this act, any | 0016| unexpended or unencumbered balance remaining from the proceeds | 0017| of the severance tax bonds issued pursuant to Sections 2 | 0018| through 6 of this act at the end of fiscal year 2000 shall | 0019| revert to the severance tax bonding fund. | 0020| Section 2. SEVERANCE TAX BONDS--STATE AGENCY ON AGING-- | 0021| PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0022| upon certification by the state agency on aging that the need | 0023| exists for the issuance of the bonds, the following amounts are | 0024| appropriated to the state agency on aging for the following | 0025| purposes: | 0001| A. two hundred fifty thousand dollars ($250,000) to | 0002| design, construct, equip or furnish a senior citizen building | 0003| in San Jon located in Quay county; and | 0004| B. one hundred thousand dollars ($100,000) to | 0005| design and construct a recreational center for the Logan senior | 0006| center located in Quay county. | 0007| Section 3. SEVERANCE TAX BONDS--OFFICE OF CULTURAL | 0008| AFFAIRS--PURPOSE.--Pursuant to the provisions of Section 1 of | 0009| this act, upon certification by the office of cultural affairs | 0010| that the need exists for the issuance of the bonds, eighty | 0011| thousand dollars ($80,000) is appropriated to the office of | 0012| cultural affairs to design, construct and equip improvements to | 0013| the Vietnam veterans war memorial located in Colfax county. | 0014| Section 4. SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0015| PUBLIC EDUCATION--PURPOSES.--Pursuant to the provisions of | 0016| Section 1 of this act, upon certification by the state | 0017| department of public education that the need exists for the | 0018| issuance of the bonds, the following amounts are appropriated | 0019| to the state department of public education for the following | 0020| purposes: | 0021| A. sixty thousand dollars ($60,000) to purchase a | 0022| school bus for the Roy school district located in Harding | 0023| county; | 0024| B. ten thousand dollars ($10,000) to purchase and | 0025| install new computer hardware or software in the House school | 0001| district located in Quay county; | 0002| C. one hundred forty-five thousand dollars | 0003| ($145,000) to complete technology networking in Cimarron | 0004| municipal school district buildings located in Colfax county; | 0005| D. one hundred thousand dollars ($100,000) to | 0006| purchase and install new lighting fixtures at Leon Williams | 0007| stadium in Clovis located in Curry county; and | 0008| E. fifty thousand dollars ($50,000) for technology | 0009| upgrades for the Des Moines school district located in Union | 0010| county. | 0011| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0012| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of | 0013| Section 1 of this act, upon certification by the local | 0014| government division of the department of finance and | 0015| administration that the need exists for the issuance of the | 0016| bonds, the following amounts are appropriated to the local | 0017| government division for the following purposes: | 0018| A. thirty-five thousand dollars ($35,000) to | 0019| purchase an ambulance for the Conchas dam volunteer fire | 0020| department located in San Miguel county; | 0021| B. fifty thousand dollars ($50,000) to design, | 0022| construct and inspect water system improvements for the Solano | 0023| mutual domestic water consumers association located in Harding | 0024| county; | 0025| C. one hundred twenty thousand dollars ($120,000) | 0001| to purchase, install or construct equipment, furnishings or | 0002| building improvements to Union county general hospital located | 0003| in Union county; | 0004| D. one hundred thousand dollars ($100,000) for site | 0005| development for a community center in the village of Cimarron | 0006| located in Colfax county; | 0007| E. seventy-five thousand dollars ($75,000) to | 0008| design, construct, inspect and repair improvements to the | 0009| restrooms, structure and parking lot of the Colfax county | 0010| courthouse located in Colfax county; | 0011| F. three hundred thousand dollars ($300,000) to | 0012| acquire land for and design a multipurpose special events | 0013| center for the city of Clovis located in Curry county; | 0014| G. thirty-nine thousand dollars ($39,000) to | 0015| purchase and install a water storage tank and water lines for | 0016| the village of Grady located in Curry county; | 0017| H. eighty thousand dollars ($80,000) for | 0018| architectural and engineering services for a new public safety | 0019| building in Tucumcari located in Quay county; | 0020| I. six hundred thousand dollars ($600,000) to | 0021| design, construct and inspect improvements to the sewer and | 0022| water systems in the village of Eagle Nest located in Colfax | 0023| county; | 0024| J. two hundred forty-three thousand dollars | 0025| ($243,000) to design, construct, install or equip a new | 0001| elevator and door and restroom modifications at the Union | 0002| county courthouse located in Union county; | 0003| K. one hundred fifty thousand dollars ($150,000) to | 0004| design, construct or equip water system improvements for the | 0005| town of Clayton water system located in Union county; | 0006| L. ten thousand dollars ($10,000) to design, | 0007| construct and equip improvements to the Colfax county sheriff's | 0008| office located in Colfax county; | 0009| M. seventy-five thousand dollars ($75,000) to | 0010| design, construct, equip and furnish an addition to the Harding | 0011| county community building located in Harding county; | 0012| N. two hundred fifty thousand dollars ($250,000) to | 0013| design, construct and equip electrical system upgrades for the | 0014| town of Springer located in Colfax county; | 0015| O. two hundred fifty thousand dollars ($250,000) to | 0016| design and construct repairs to the water system of the town of | 0017| Springer located in Colfax county; | 0018| P. two hundred fifty thousand dollars ($250,000) to | 0019| design, construct and equip water and sewer improvements for | 0020| the village of Angel Fire located in Colfax county; | 0021| Q. two hundred thousand dollars ($200,000) to | 0022| purchase equipment for the Tucumcari fire department located in | 0023| Quay county; and | 0024| R. one hundred twenty-five thousand dollars | 0025| ($125,000) to design, construct, furnish and equip a new | 0001| building for the Roy volunteer fire department located in | 0002| Harding county. | 0003| Section 6. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0004| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the | 0005| provisions of Section 1 of this act, upon certification by the | 0006| state highway and transportation department that the need | 0007| exists for the issuance of the bonds, the following amounts are | 0008| appropriated to the state highway and transportation department | 0009| for the following purposes: | 0010| A. six hundred thousand dollars ($600,000) to | 0011| design and construct passing lanes on United States highway | 0012| 64/87 at the Colfax county road A-40 turnoff located in Colfax | 0013| county; and | 0014| B. two hundred twenty-five thousand dollars | 0015| ($225,000) to improve and rehabilitate portions of state road | 0016| 72 and United States highway 64/87 within the Raton city limits | 0017| located in Colfax county. | 0018| Section 7. EMERGENCY.--It is necessary for the public | 0019| peace, health and safety that this act take effect immediately. | 0020|  |
