EISENSTADT | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| CREATING A JOINT INTERIM LEGISLATIVE PUBLIC REGULATION | 0012| COMMITTEE; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. PUBLIC REGULATION INTERIM COMMITTEE CREATED-- | 0016| TERMINATION.--There is created a joint interim legislative | 0017| committee that shall be known as the "public regulation interim | 0018| committee". The committee shall function from the date of its | 0019| appointment until the first day of December prior to the second | 0020| session of the forty-third legislature. | 0021| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.-- | 0022| A. The public regulation interim committee shall be | 0023| composed of twelve members. The New Mexico legislative council | 0024| shall appoint six members from the house of representatives and | 0025| six members from the senate. At the time of making the | 0001| appointment, the legislative council shall designate the | 0002| chairman and vice chairman of the committee. | 0003| B. Members shall be appointed from each house so as | 0004| to give the two major political parties in each house the same | 0005| proportionate representation on the committee as prevails in | 0006| each house; however, in no event shall either party have less | 0007| than one member from each house on the committee. At the | 0008| request of the committee chairman, members may be removed from | 0009| the committee by the New Mexico legislative council for | 0010| nonattendance according to council policy. Vacancies on the | 0011| committee, however caused, may be filled by the legislative | 0012| council, or the council may reduce the size of the committee by | 0013| not making replacement appointments and in such case need not | 0014| readjust party representation. | 0015| C. The legislative council may appoint up to three | 0016| public members representing consumer interests and three public | 0017| members representing industries regulated by the New Mexico | 0018| public utility commission and the state corporation commission | 0019| to serve as advisory members to the committee. The advisory | 0020| public members shall be appointed so as to reflect the state's | 0021| ethnic and geographic diversity. The advisory members shall be | 0022| paid per diem and mileage as nonsalaried public officials | 0023| pursuant to the Per Diem and Mileage Act. | 0024| D. No action shall be taken by the committee if a | 0025| majority of the total membership from either house on the | 0001| committee rejects such action. | 0002| Section 3. DUTIES.--After its appointment, the public | 0003| regulation interim committee shall hold one organizational | 0004| meeting to develop a work plan and budget for the ensuing | 0005| interim. The work plan and budget shall be submitted to the | 0006| New Mexico legislative council for approval. Upon approval of | 0007| the work plan and budget by the legislative council, the | 0008| committee shall examine the statutes, constitutional | 0009| provisions, regulations and court decisions governing the state | 0010| corporation commission and the New Mexico public utility | 0011| commission in New Mexico and recommend legislation or changes | 0012| necessary to create a unified public regulation commission, as | 0013| provided by Article 11, Sections 1 and 2 of the constitution of | 0014| New Mexico, to the second session of the forty-third | 0015| legislature. | 0016| Section 4. SUBCOMMITTEES.--Subcommittees shall be created | 0017| only by majority vote of all members appointed to the public | 0018| regulation interim committee and with the prior approval of the | 0019| New Mexico legislative council. A subcommittee shall be | 0020| composed of at least one member from the senate and one member | 0021| from the house of representatives, and at least one member of | 0022| the minority party shall be a member of the subcommittee. All | 0023| meetings and expenditures of a subcommittee shall be approved | 0024| by the full committee in advance of such meeting or | 0025| expenditure, and the approval shall be shown in the minutes of | 0001| the committee. | 0002| Section 5. STATE CORPORATION COMMISSION AND NEW MEXICO | 0003| PUBLIC UTILITY COMMISSION COOPERATION AND ASSISTANCE.--The | 0004| state corporation commission and the New Mexico public utility | 0005| commission shall assist and cooperate with the public | 0006| regulation interim committee and provide information and | 0007| materials related to the consolidation of the agencies as | 0008| requested by the committee. | 0009| Section 6. REPORT.--The public regulation interim | 0010| committee shall make a report of its findings and | 0011| recommendations for the consideration of the second session of | 0012| the forty-third legislature. The report and suggested | 0013| legislation shall be made available to the New Mexico | 0014| legislative council on or before December 15 preceding that | 0015| session. | 0016| Section 7. STAFF.--The staff for the public regulation | 0017| interim committee shall be provided by the legislative council | 0018| service. | 0019| Section 8. APPROPRIATION.--One hundred thousand dollars | 0020| ($100,000) is appropriated from the general fund to the | 0021| legislative council service for expenditure in fiscal years | 0022| 1997 and 1998 for the purpose of paying the salaries and | 0023| expenses of the technical, legal, clerical and stenographic | 0024| assistants, for necessary equipment and supplies used in | 0025| carrying out the provisions of this act and for reimbursing the | 0001| per diem and mileage expenses of the public regulation interim | 0002| committee. Any unexpended or unencumbered balance remaining at | 0003| the end of fiscal year 1998 shall revert to the general fund. | 0004| Payments from the appropriation shall be made upon vouchers | 0005| signed by the director of the legislative council service or | 0006| his authorized representative. | 0007| Section 9.
