0001| SENATE BILL 667 | 0002| 43rd legislature - STATE OF NEW MEXICO - first session, 1997 | 0003| INTRODUCED BY | 0004| GLORIA HOWES | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO LAW ENFORCEMENT; PROVIDING CONSERVATION OFFICERS | 0012| WITH AUTHORITY TO ENFORCE CERTAIN CRIMINAL LAWS; AMENDING A | 0013| SECTION OF THE NMSA 1978. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 17-2-19 NMSA 1978 (being Laws 1912, | 0017| Chapter 85, Section 57, as amended) is amended to read: | 0018| "17-2-19. ENFORCEMENT OF GAME LAWS--POWERS OF CONSERVA- | 0019| | 0020| TION OFFICERS.-- | 0021| A. The director of the department of game and fish, | 0022| each conservation officer, each sheriff in his respective | 0023| county and each member of the New Mexico state police shall | 0024| enforce Chapter 17 NMSA 1978 and shall: | 0025| (1) seize any game or fish held in violation | 0001| of that chapter; | 0002| (2) with or without warrant, arrest any person | 0003| whom he knows to be guilty of a violation of that chapter; and | 0004| (3) open, enter and examine all camps, wagons, | 0005| cars, tents, packs, boxes, barrels and packages where he has | 0006| reason to believe any game or fish taken or held in violation | 0007| of that chapter is to be found, and seize it. | 0008| B. Any warrant for the arrest of a person shall be | 0009| issued upon sworn complaint, the same as in other criminal | 0010| cases, and any search warrant shall issue upon a written | 0011| showing of probable cause, supported by oath or affirmation, | 0012| describing the places to be searched or the persons or things | 0013| to be seized. | 0014| C. Conservation officers may, under the direction | 0015| of the state game commission and the director of the department | 0016| of game and fish: | 0017| (1) establish from time to time, as needed for | 0018| the proper functioning of the game and fish research and | 0019| management division, checking stations at points along | 0020| established roads, or roadblocks, for the purpose of detecting | 0021| and apprehending persons violating the game and fish laws and | 0022| the regulations referred to in Section 17-2-10 NMSA 1978; | 0023| (2) under emergency circumstances and while on | 0024| official duty only and except as otherwise provided in | 0025| Paragraph (3) of this subsection, enforce the provisions of the | 0001| Criminal Code and the Motor Vehicle Code; and | 0002| (3) while on official duty only, enforce the | 0003| provisions of: | 0004| (a) Sections 30-14-1 and 30-14-1.1 | 0005| NMSA 1978 pertaining to criminal trespass; | 0006| (b) Section 30-3-1 NMSA 1978, pertaining | 0007| to assault; | 0008| (c) Section 30-3-4 NMSA 1978, pertaining | 0009| to battery; | 0010| (d) Section 30-7-2 NMSA 1978, pertaining | 0011| to unlawful carrying of a deadly weapon; | 0012| (e) Section 30-7-4 NMSA 1978, pertaining | 0013| to negligent use of a deadly weapon; | 0014| (f) Section 30-14-4 NMSA 1978, | 0015| pertaining to wrongful use of public property; | 0016| (g) Section 30-15-1 NMSA 1978, | 0017| pertaining to criminal damage to property; | 0018| (h) Section 30-16-6 NMSA 1978, | 0019| pertaining to fraud, but only when the fraud is associated with | 0020| outfitting or guiding services; | 0021| (i) Section 30-22-1 NMSA 1978, | 0022| pertaining to resisting, evading or obstructing an officer; | 0023| (j) Section 30-22-3 NMSA 1978, | 0024| pertaining to concealing identity; and | 0025| (k) Section 72-1-8 NMSA 1978, pertaining | 0001| to camping next to a manmade water hole." | 0002| Section 2.
