0011|     RELATING TO GAME AND FISH; AMENDING A SECTION OF THE NMSA 1878

0012|     PERTAINING TO DEFINITION OF RESIDENT FOR PURPOSES OF PURCHASING
    |
0013|     A HUNTING AND FISHING LICENSE.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 17-3-4 NMSA 1978 (being Laws 1964 (1st
    |
0017|     S.S.), Chapter 17, Section 4, as amended) is amended to read:
    |
0018|          "17-3-4.  RESIDENCE.--As used in Chapter 17 NMSA 1978:
    |
0019|               A.  a "resident" entitled to purchase resident
    |
0020|     hunting and fishing licenses is any person:
    |
0021|                    (1)  who is a United States citizen and who,
    |
0022|     for a period of not less than ninety days immediately preceding
    |
0023|     the date of application for the license, has been domiciled in
    |
0024|     New Mexico and has not claimed residency elsewhere for any
    |
0025|     purpose;
    |
0001|                    (2)  who is not a citizen of the United States
    |
0002|     but who is legally within the United States and has actually
    |
0003|     lived in this state for ninety days immediately preceding his
    |
0004|     license application;
    |
0005|                    (3)  not otherwise entitled to claim residence,
    |
0006|     who is a student attending any educational institution in this
    |
0007|     state, has so attended and actually lived in this state for at
    |
0008|     least one full term immediately preceding his license
    |
0009|     application and presents with his application a certificate of
    |
0010|     such attendance from proper authorities of the educational
    |
0011|     institution;
    |
0012|                    (4)  not otherwise entitled to claim residence,
    |
0013|     who is a member of the armed forces of the United States and
    |
0014|     permanently assigned to a military installation located within
    |
0015|     this state and presents with his license application a
    |
0016|     certificate of such assignment from his commanding officer or
    |
0017|     designated representative, or the spouse or dependent of such
    |
0018|     person, not otherwise entitled to claim residence, living
    |
0019|     within the same household and similarly certified by the
    |
0020|     person's commanding officer; <s>[or]</s>
    |
0021|                 (5)  not otherwise entitled to claim residence,
    |
0022|     who is a member of the armed forces of the United States and
    |
0023|     officially stationed at a military reservation located
    |
0024|     partially in this state and partially in an adjacent state, but
    |
0025|     only for a special license valid only for hunting and fishing
    |
0001|     in this state on those reservations; <s>[and]</s> <u>or
</u>    |
<u></u>0002| <u>                (6)  not otherwise entitled to claim residence,
</u>    |
<u></u>0003| <u>    who has paid a New Mexico individual income or property tax
</u>    |
<u></u>0004| <u>    within the current year of application for a license or in the
</u>    |
<u></u>0005| <u>    year immediately preceding the application for a license; and</u>
    |
0006|             B.  a "nonresident" who must purchase nonresident
    |
0007|     hunting and fishing licenses is any person not a resident,
    |
0008|     including any temporary resident who maintains his home outside
    |
0009|     of the state."
