0011| RELATING TO STATUTORY CONSTRUCTION; INCLUDING PLANNING AND

0012| DESIGNING WITHIN THE MEANINGS OF PAVE OR CONSTRUCT; DECLARING

0013| AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. A new section of Chapter 12, Article 2 NMSA
|
0017| 1978 is enacted to read:
|
0018| "[NEW MATERIAL] USE OF CONSTRUCT OR PAVE IN STATUTE.--
|
0019| As used in all New Mexico statutes unless explicitly stated
|
0020| otherwise:
|
0021| A. "construct" may include the planning or
|
0022| designing phase of a construction project if those functions
|
0023| have not been completed; and
|
0024| B. "pave" may include the planning, designing or
|
0025| engineering phase of a paving project if those functions have
|
0001| not been completed."
|
0002| Section 2. EMERGENCY.--It is necessary for the public
|
0003| peace, health and safety that this act take effect immediately.
