0011|     RELATING TO CRIMINAL APPEALS; PROVIDING THAT A DEFENDANT
    |
0012|     CONVICTED OF ABUSE OF A CHILD THAT RESULTS IN GREAT BODILY HARM
    |
0013|     OR DEATH TO THE CHILD IS NOT ENTITLED TO RELEASE PENDING
    |
0014|     APPEAL; AMENDING A SECTION OF THE NMSA 1978.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 31-11-1 NMSA 1978 (being Laws 1917,
    |
0018|     Chapter 43, Section 58, as amended) is amended to read:
    |
0019|          "31-11-1.  STAY OF EXECUTION--RELEASE.--
    |
0020|               A.  All appeals and writs of error in criminal cases
    |
0021|     have the effect of a stay of execution of the sentence of the
    |
0022|     district court until the decision of the supreme court or court
    |
0023|     of appeals.
    |
0024|               B.  If a defendant is convicted of a capital or
    |
0025|     violent offense and is sentenced to death or a term of
    |
0001|     imprisonment not suspended in whole, he shall not be entitled
    |
0002|     to release pending appeal.
    |
0003|               C.  If a defendant is convicted of a noncapital
    |
0004|     offense other than a violent offense and is sentenced to a term
    |
0005|     of imprisonment not suspended in whole, he shall not be
    |
0006|     entitled to release pending appeal unless the court finds:
    |
0007|                    (1)  by clear and convincing evidence that the
    |
0008|     person is not likely to flee or pose a danger to the safety of
    |
0009|     any other person or the community if released; and
    |
0010|                    (2)  that the appeal is not for the purpose of
    |
0011|     delay and raises a substantial question of law or fact likely
    |
0012|     to result in reversal or an order for a new trial.
    |
0013|               D.  As used in Subsections B and C of this section,
    |
0014|     "violent offense" means:
    |
0015|                    (1) <s>[kidnaping]</s> <u>kidnapping</u>;
    |
0016|                    (2)  criminal sexual penetration in the first
    |
0017|     or second degree;
    |
0018|                    (3)  armed robbery;
    |
0019|                    (4)  murder in the second degree;
    |
0020|                    (5)  aggravated burglary;
    |
0021|                    (6)  aggravated arson; <s>[or]</s>
    |
0022|                    (7)  assault with intent to commit violent
    |
0023|     felony upon peace officer; <u>or</u>
    |

0024|                    <u>(8)  abuse of a child that results in great
</u>    |
<u></u>0025| <u>    bodily harm or death to the child.</u>
    |
0001|               E.  In all parole and probation revocation
    |
0002|     proceedings, where the alleged violation by the parolee or
    |
0003|     probationer of the conditions of release poses a threat to
    |
0004|     himself or others, the defendant shall not be entitled to be
    |
0005|     released on bail pending the decision on revocation.  In those
    |
0006|     instances where the state has failed to conduct a preliminary
    |
0007|     parole revocation hearing on a parolee held for parole
    |
0008|     violations within sixty days of arrest, the parolee shall be
    |
0009|     eligible for bail.  In all cases, the final parole revocation
    |
0010|     hearing shall be scheduled for hearing within sixty days of the
    |
0011|     parolee's return to the penitentiary.  In the case of probation
    |
0012|     violation, if the final probation revocation hearing is not
    |
0013|     brought before the court within sixty days, then the
    |
0014|     probationer shall be eligible for bail."
    |
0015|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0016|     provisions of this act is July 1, 1997.
