Section 17-3-2 NMSA 1978 (being Laws 1964 (1st | 0017| S.S.), Chapter 17, Section 2, as amended) is amended to read: | 0018| "17-3-2. CLASSES OF LICENSES.-- | 0019| A. As used with reference to licenses in Chapter 17 | 0020| NMSA 1978: | 0021| (1) "fishing" entitles the licensee to fish | 0022| for game fish during the open seasons for each species; | 0023| (2) "small game" entitles the licensee to hunt | 0024| game birds, other than wild turkey, and squirrel during the | 0025| open seasons for each; | 0001| (3) "deer" entitles the licensee to hunt deer | 0002| during the open season; | 0003| (4) "general hunting" entitles the licensee to | 0004| hunt deer, squirrel and game birds during the open seasons for | 0005| each; | 0006| (5) "general hunting and fishing" entitles the | 0007| licensee to hunt deer, squirrel and game birds and to fish for | 0008| game fish during the open seasons for each; | 0009| (6) "antelope" entitles the licensee to hunt | 0010| antelope during the open season; | 0011| (7) "elk" entitles the licensee to hunt elk | 0012| during the open season; | 0013| (8) "bighorn sheep" entitles the licensee to | 0014| hunt bighorn sheep during the open season; | 0015| (9) "Barbary sheep" entitles the licensee to | 0016| hunt Barbary sheep during the open season; | 0017| (10) "javelina" entitles the licensee to hunt | 0018| javelina during the open season; | 0019| (11) "bear" entitles the licensee to hunt bear | 0020| during the open season; | 0021| (12) "nongame" entitles the licensee to hunt | 0022| or take any animal or bird not protected by law; | 0023| (13) "temporary fishing" entitles the licensee | 0024| to fish for game fish during a specific period of time | 0025| indicated on the license; | 0001| (14) "bison" entitles the licensee to hunt | 0002| bison during the open season; | 0003| (15) "oryx" entitles the licensee to hunt oryx | 0004| during the open season; | 0005| (16) "ibex" entitles the licensee to hunt ibex | 0006| during the open season; | 0007| (17) "cougar" entitles the licensee to hunt | 0008| cougar during the open season; | 0009| (18) "turkey" entitles the licensee to hunt | 0010| turkey during the open season; | 0011| (19) "special season turkey" entitles the | 0012| licensee to hunt turkey during special seasons designated by the | 0013| state game commission; | 0014| (20) "quality elk" entitles the licensee to hunt | 0015| elk during a special quality elk season, to be established by the | 0016| state game commission, when the timing of the season and hunter | 0017| density is specially regulated and the elk population is managed | 0018| with an intent to provide the licensee an increased opportunity to | 0019| take a mature elk; | 0020| (21) "quality deer" entitles the licensee to | 0021| hunt deer during a special quality deer season, to be established | 0022| by the state game commission, when the timing of the season and | 0023| hunter density is specially regulated and the deer population is | 0024| managed with an intent to provide the licensee an increased | 0025| opportunity to take a mature deer; and | 0001| (22) "gazelle" entitles the licensee to hunt | 0002| gazelle during the open season. | 0003| B. No hunting license entitles the licensee to hunt, | 0004| kill or take game animals or birds within or upon any park or | 0005| enclosure licensed or posted as provided by law or within or upon | 0006| any privately owned enclosure without consent of the owner or | 0007| within or upon any game refuge or game management area. | 0008| C. No fishing license entitles the licensee to fish | 0009| for or take fish within or upon any park or enclosure licensed or | 0010| posted as provided by law or within or upon any privately owned | 0011| enclosure without consent of the owner or in or on any closed | 0012| waters. | 0013| D. A junior[-senior] fishing license may be purchased | 0014| by any resident who has reached his twelfth birthday but has not | 0015| reached his fifteenth birthday [or by any resident who has reached | 0016| his sixty-fifth birthday]. A junior[-senior] fishing license | 0017| entitles the licensee to fish for game fish during the open season | 0018| for each species. | 0019| E. A nonresident junior fishing license may be | 0020| purchased by any nonresident who has reached his twelfth birthday | 0021| but has not reached his fifteenth birthday. A nonresident junior | 0022| fishing license entitles the licensee to fish for game fish during | 0023| the open season for each species. | 0024| [F. None of the classes of trout stamps provided for | 0025| in Subsection A of this section is required of any person fishing | 0001| on lands of any Indian pueblo or tribe. | 0002| G.] F. A senior general hunting license may be | 0003| purchased by any resident who has reached his sixty-fifth | 0004| birthday. A senior general hunting license entitles the licensee | 0005| to hunt for deer, squirrel and game birds during the open seasons | 0006| for each species. | 0007| [H.] G. A handicapped fishing license may be purchased | 0008| by any resident who has a severe physical impairment that | 0009| substantially limits one or more major life activities and who can | 0010| furnish adequate proof of this disability to the state game | 0011| commission. A handicapped fishing license may be purchased by any | 0012| resident who has a developmental disability as defined in | 0013| Subsection H of Section 43-1-3 NMSA 1978 and who can furnish | 0014| adequate proof of this disability to the state game commission. A | 0015| handicapped fishing license entitles the licensee to fish for game | 0016| fish during the open season for each species [provided, however, | 0017| the class C trout stamp would apply]. | 0018| [I.] H. A handicapped general hunting license may be | 0019| purchased by any resident who has a severe physical impairment | 0020| that substantially limits one or more major life activities and | 0021| who can furnish adequate proof of this disability to the state | 0022| game commission. A handicapped general hunting license entitles | 0023| the licensee to hunt for deer, squirrel and game birds during the | 0024| open season for each species. | 0025| [J.] I. A fishing license may be obtained at no cost | 0001| by any resident who has reached his [seventieth] sixty-fifth | 0002| birthday." | 0003|  |
