Section 66-7-372 NMSA 1978 (being Laws 1985, | 0016| Chapter 131, Section 3, as amended) is amended to read: | 0017| "66-7-372. SAFETY BELT USE REQUIRED--EXCEPTION.-- | 0018| A. Except as provided by Section 66-7-369 NMSA | 0019| 1978 and in Subsection B of this section, each front and | 0020| rear seat occupant of a motor vehicle having a gross vehicle | 0021| weight of ten thousand pounds or less manufactured with safety | 0022| belts in compliance with federal motor vehicle safety standard | 0023| number 208 shall have a safety belt properly fastened about | 0024| his body at all times when the vehicle is in motion on any | 0025| street or highway, unless all seating positions equipped with | - 1 - 0001| safety belts are occupied. | 0002| B. This section shall not apply to an occupant of | 0003| a motor vehicle having a gross vehicle weight of ten thousand | 0004| pounds or less who possesses a written statement from a | 0005| licensed physician that he is unable for medical reasons to | 0006| wear a safety belt or to a rural letter carrier of the United | 0007| States postal service while performing the duties of a rural | 0008| letter carrier." | 0009| Section 2. Section 66-8-116 NMSA 1978 (being Laws 1978, | 0010| Chapter 35, Section 524, as amended) is amended to read: | 0011| "66-8-116. PENALTY ASSESSMENT MISDEMEANORS-- | 0012| DEFINITION--SCHEDULE OF ASSESSMENTS.-- | 0013| A. When an alleged violator of a penalty assessment | 0009| misdemeanor elects to accept a notice to appear in lieu of a | 0010| notice of penalty assessment, no fine imposed upon later | 0011| conviction shall exceed the penalty assessment established for | 0012| the particular penalty assessment misdemeanor and no probation | 0013| imposed upon a suspended or deferred sentence shall exceed ninety | 0014| days." | 0015| Section 3.
