0011|     RELATING TO STATE POLICE RETIREMENT; PROVIDING FOR INCREASE TO

0012|     ACTUAL CREDITED SERVICE FOR MEMBERS UNLESS THEY HOLD AN EXEMPT

0013|     RANK ABOVE CAPTAIN; AMENDING SECTION 10-11-27 NMSA 1978 (BEING

0014|     LAWS 1987, CHAPTER 253, SECTION 27).

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 10-11-27 NMSA 1978 (being Laws 1987,
    |
0018|     Chapter 253, Section 27) is amended to read:
    |
0019|          "10-11-27.  STATE POLICE MEMBER COVERAGE PLAN 1--
    |
0020|     APPLICABILITY.--State police member coverage plan 1 is
    |
0021|     applicable to state police members who are not specifically
    |
0022|     covered by another coverage plan.  The credited service of a
    |
0023|     state police member <s>[who has held the permanent rank of
</s>    |
<s></s>0024| <s>    patrolman or sergeant and does not hold an exempt rank or who
</s>    |
<s></s>0025| <s>    is assigned to the aircraft division as a pilot]</s> shall have
    |

0001|     actual credited service increased by twenty percent for the

0002|     purposes of state police member coverage plan 1, <u>except that
</u>    |
<u></u>0003| <u>    during periods when a state police member holds an exempt rank
</u>    |
<u></u>0004| <u>    above the rank of captain, actual credited service shall not
</u>    |
<u></u>0005| <u>    be increased unless the state police member is assigned as a
</u>    |
<u></u>0006| <u>    pilot</u>."

0007|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0008|     provisions of this act is July 1, 1998.
