0011|     RELATING TO EDUCATION; ENACTING THE CAREER EDUCATION
    |
0012|     OPPORTUNITIES IN WORK FORCE DEVELOPMENT ACT; MAKING AN
    |
0013|     APPROPRIATION.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Public School Code is
    |
0017|     enacted to read:
    |
0018|          "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
    |
0019|     the "Career Education Opportunities in Work Force Development
    |
0020|     Act"."
    |
0021|          Section 2.  A new section of the Public School Code is
    |
0022|     enacted to read:
    |
0023|          "[NEW MATERIAL] PURPOSE OF ACT.--The purpose of the
    |
0024|     Career Education Opportunities in Work Force Development Act
    |
0025|     is to:
    |

0001|               A.  expand and sustain the statewide school-to-work
    |
0002|     system after the federal school-to-work grant ends;
    |
0003|               B.  expand partnerships among public schools,
    |
0004|     public post-secondary educational institutions, business,
    |
0005|     industry and public entities to sustain an education system
    |
0006|     that meets the needs of New Mexico's current and future work
    |
0007|     force;
    |
0008|               C.  support student achievement of academic,
    |
0009|     technical and career competencies required in present and
    |
0010|     future work environments through an effective career education
    |
0011|     system; and
    |
0012|               D.  support the establishment of procedures to
    |
0013|     assist student transition from school to post-secondary
    |
0014|     education, advanced training or employment."
    |
0015|          Section 3.  A new section of the Public School Code is
    |
0016|     enacted to read:
    |
0017|          "[NEW MATERIAL] DEFINITIONS.--As used in the Career
    |
0018|     Education Opportunities in Work Force Development Act:
    |
0019|               A.  "council" means the career education
    |
0020|     coordinating council;
    |
0021|               B.  "department" means the department of education;
    |
0022|     and
    |
0023|               C.  "division" means the vocational education
    |
0024|     division of the department."
    |
0025|          Section 4.  A new section of the Public School Code is
    |

0001|     enacted to read:
    |
0002|          "[NEW MATERIAL] DEPARTMENT DUTIES.--The department
    |
0003|     shall:
    |
0004|               A.  implement the provisions of the Career
    |
0005|     Education Opportunities in Work Force Development Act; and
    |
0006|               B.  cooperate with the executive, including the
    |
0007|     labor department; legislature; school districts; public post-
    |
0008|     secondary institutions; business; and industry, to expand and
    |
0009|     sustain a career education system that provides:
    |
0010|                    (1)  work-based learning opportunities that
    |
0011|     include practical work and learning experiences within the
    |
0012|     workplace;
    |
0013|                    (2)  school-based learning opportunities that
    |
0014|     include career exploration and mastery of vocational,
    |
0015|     technical and career competencies; and
    |
0016|                    (3)  connecting activities that link work-
    |
0017|     based learning to school-based learning to:
    |
0018|                         (a)  match students with employers and
    |
0019|     establish relationships between education and work;
    |
0020|                         (b)  provide technical assistance to
    |
0021|     schools, students and employers;
    |
0022|                         (c)  promote successful business and
    |
0023|     industry participation;
    |
0024|                         (d)  provide services to assist students
    |
0025|     in job placement and admission into post-secondary education
    |

0001|     and training;
    |
0002|                         (e)  establish linkages between career
    |
0003|     development activities and industry; and
    |
0004|                         (f)  collect data to evaluate the
    |
0005|     effectiveness of the career education system based on student
    |
0006|     performance and program success indicators."
    |
0007|          Section 5.  A new section of the Public School Code is
    |
0008|     enacted to read:
    |
0009|          "[NEW MATERIAL] CAREER EDUCATION OPPORTUNITIES.--The
    |
0010|     department shall administer the Career Education Opportunities
    |
0011|     in Work Force Development Act.  The department shall:
    |
0012|               A.  cooperate with other agencies to coordinate the
    |
0013|     delivery of programs and services to develop a highly
    |
0014|     qualified state work force;
    |
0015|               B.  coordinate statewide training activities for
    |
0016|     teachers, employers, mentors, counselors and other related
    |
0017|     personnel;
    |
0018|               C.  establish procedures to promote career
    |
0019|     education opportunities;
    |
0020|               D.  establish procedures to coordinate education
    |
0021|     and career preparation;
    |
0022|               E.  coordinate the development of state guidelines
    |
0023|     for job placement policies and procedures;
    |
0024|               F.  conduct statewide activities to support schools
    |
0025|     in implementing career education opportunities;
    |

0001|               G.  promote career education opportunities for
    |
0002|     students with disabilities and students who are at risk of
    |
0003|     dropping out; and
    |
0004|               H.  coordinate the development of a state plan to
    |
0005|     expand and sustain career education opportunities, including
    |
0006|     plans to ensure financial stability through effective use of
    |
0007|     state and federal resources."
    |
0008|          Section 6.  A new section of the Public School Code is
    |
0009|     enacted to read:
    |
0010|          "[NEW MATERIAL] CAREER EDUCATION COORDINATING COUNCIL--
    |
0011|     CREATION--APPOINTMENT--MEMBERSHIP.--
    |
0012|               A.  The "career education coordinating council" is
    |
0013|     created as an advisory to the executive, including the state
    |
0014|     board, the commission on higher education and the legislature. 
    |
0015|     The council shall be appointed July 1, 2001 and shall be
    |
0016|     composed of fifteen members representing different
    |
0017|     geographical areas of the state and reflecting the diverse
    |
0018|     population of the state.
    |
0019|               B.  The president pro tempore of the senate shall
    |
0020|     appoint two members from the senate, one from each of the two
    |
0021|     major political parties, for terms of two years or less to
    |
0022|     coincide with their terms of office.
    |
0023|               C.  The speaker of the house shall appoint two
    |
0024|     members from the house of representatives, one from each of
    |
0025|     the two major political parties, for terms of two years or
    |

0001|     less to coincide with their terms of office.
    |
0002|               D.  The president of the state board shall appoint
    |
0003|     a representative of the state board to a four-year term or
    |
0004|     until his term of office expires.
    |
0005|               E.  The governor shall appoint a representative
    |
0006|     from the governor's office to serve a four-year term.
    |
0007|               F.  Nine members shall be appointed jointly by the
    |
0008|     governor, the speaker of the house of representatives, the
    |
0009|     president pro tempore of the senate and the president of the
    |
0010|     state board as follows:
    |
0011|                    (1)  one representative of the division for a
    |
0012|     four-year term;
    |
0013|                    (2)  one representative of the job training
    |
0014|     division of the labor department for a four-year term;
    |
0015|                    (3)  one representative of the vocational
    |
0016|     rehabilitation division of the department for a four-year
    |
0017|     term;
    |
0018|                    (4)  one representative of a two-year post-
    |
0019|     secondary institution for a four-year term;
    |
0020|                    (5)  one representative of organized labor for
    |
0021|     a four-year term;
    |
0022|                    (6)  two representatives of the private sector
    |
0023|     for four-year terms; and
    |
0024|                    (7)  two representatives from public schools,
    |
0025|     to include an administrator and a teacher, for four-year
    |

0001|     terms."
    |
0002|          Section 7.  A new section of the Public School Code is
    |
0003|     enacted to read:
    |
0004|          "[NEW MATERIAL] COUNCIL--PURPOSE AND DUTIES.--
    |
0005|               A.  The purpose of the council is to serve as
    |
0006|     advisory to the state work force development board in the
    |
0007|     development of the state strategic plan to coordinate state
    |
0008|     and federal funds to establish a highly qualified work force.
    |
0009|               B.  The council shall:
    |
0010|                    (1)  make recommendations to the executive,
    |
0011|     including the state board and the legislature regarding the
    |
0012|     coordination of federal and state work force education funds;
    |
0013|     and
    |
0014|                    (2)  make policy recommendations to the state
    |
0015|     board, the commission on higher education and the state work
    |
0016|     force development board on the development of a state process
    |
0017|     for evaluating the effectiveness of the career education
    |
0018|     opportunities system."
    |
0019|          Section 8.  A new section of the Public School Code is
    |
0020|     enacted to read:
    |
0021|          "[NEW MATERIAL] STAFFING.--In order to carry out its
    |
0022|     function, the career education coordinating council may:
    |
0023|               A.  use department funds available for state
    |
0024|     councils under applicable career education-related programs;
    |
0025|     and
    |

0001|               B.  be staffed by division employees."
    |
0002|          Section 9.  A new section of the Public School Code is
    |
0003|     enacted to read:
    |
0004|          "[NEW MATERIAL] ANNUAL REPORTS.--The department shall
    |
0005|     submit annually to the legislative education study committee a
    |
0006|     report regarding the expenditure of funds to expand and
    |
0007|     sustain career education opportunities and an evaluation
    |
0008|     report documenting the benefits of the program to students and
    |
0009|     employers."
    |
0010|          Section 10.  APPROPRIATION.--One hundred thousand dollars
    |
0011|     ($100,000) is appropriated from the general fund to the state
    |
0012|     department of public education for expenditure in fiscal year
    |
0013|     1999 to carry out the provisions of the Career Education
    |
0014|     Opportunities in Work Force Development Act, including program
    |
0015|     development, program accountability and training.  Any
    |
0016|     unexpended or unencumbered balance remaining at the end of
    |
0017|     fiscal year 1999 shall revert to the general fund.
    |
0018|          Section 11.  EFFECTIVE DATE.--The effective date of the
    |
0019|     provisions of this act is July 1, 1998.
