0011|     RELATING TO PUBLIC FINANCE; AMENDING THE NEW MEXICO FINANCE
    |
0012|     AUTHORITY ACT; DECLARING AN EMERGENCY.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 6-21-3 NMSA 1978 (being Laws 1992,
    |
0016|     Chapter 61, Section 3, as amended) is amended to read:
    |
0017|          "6-21-3.  DEFINITIONS.--As used in the New Mexico Finance
    |
0018|     Authority Act:
    |
0019|               A.  "authority" means the New Mexico finance
    |
0020|     authority;
    |
0021|               B.  "bond" means any bonds, notes, certificates of
    |
0022|     participation or other evidence of indebtedness;
    |
0023|               C.  "bondholder" or "holder" means a person who is
    |
0024|     the owner of a bond, whether registered or not;
    |
0025|               D.  "public project" means the acquisition,
    |

0001|     construction, improvement, alteration or reconstruction of
    |
0002|     assets of a long-term capital nature by a qualified entity,
    |
0003|     including land; buildings; water rights; water, sewerage and
    |
0004|     waste disposal systems; streets; airports; municipal
    |
0005|     utilities; parking facilities; and machinery, furniture and
    |
0006|     equipment.  "Public project" includes all proposed
    |
0007|     expenditures related to the entire undertaking;
    |
0008|               E.  "qualified entity" means the state or [any]
    |
0009|     an agency or institution of the state or [any] a county;
    |
0010|     municipality; school district; land grant corporation;
    |
0011|     intercommunity water or natural gas supply [associations]
    |
0012|     association or [corporations] corporation; special
    |
0013|     district [or]; community water association; [or an] Indian
    |
0014|     nation, tribe or pueblo located wholly or partially in New
    |
0015|     Mexico, including a political subdivision or a wholly owned
    |
0016|     enterprise of an Indian nation, tribe or pueblo; or a tribal
    |
0017|     or federally created two- or four-year post-secondary
    |
0018|     educational institution located in New Mexico; and
    |
0019|               F.  "security" or "securities", unless the context
    |
0020|     indicates otherwise, means bonds, notes or other evidence of
    |
0021|     indebtedness issued by a qualified entity or leases or
    |
0022|     certificates or other evidence of participation in the
    |
0023|     lessor's interest in and rights under a lease with a qualified
    |
0024|     entity and that are payable from taxes, revenues, rates,
    |
0025|     charges, assessments or user fees or from the proceeds of
    |

0001|     funding or refunding bonds, notes or other [evidences]
    |
0002|     evidence of indebtedness of a qualified entity or from
    |
0003|     certificates or evidence of participation in a lease with a
    |
0004|     qualified entity."
    |
0005|          Section 2.  EMERGENCY.--It is necessary for the public
    |
0006|     peace, health and safety that this act take effect
    |
0007|     immediately.
